DECREE OF THE MINISTRY OF AGRICULTURE AND FORESTRY ON REGISTRATION OF PDO/PGI/TSG PRODUCTS AND NOTIFICATION OF THE MANUFACTURE OF A REGISTERED PDO/PGI/TSG PRODUCT, 17.12.2014/1153

By decision of the Ministry of Agriculture and Forestry and under section 54 d, subsection 3 and section 54 e, subsection 2 of the Food Act (23/2006), as amended by Act 881/2014, the following is enacted;

Section 1 Scope This Decree lays down further provisions on the registration of a PDO/PGI/TSG product referred to in section 54 d of the Food Act and notification of the manufacture of a registered PDO/PGI/TSG product referred to in section 54 e of the Food Act.

Section 2 Registration of a PDO/PGI/TSG product In the national objection procedure relating to the application procedure the Finnish Agency for Rural Affairs shall publish the application for the registration of a PDO/PGI/TSG product on the website of the Finnish Agency for Rural Affairs. A notification of the application shall be published in the Official Journal and the Trademark Gazette.

The objection shall be submitted by the end of the month following the date of publication of the journals.

A positive national decision concerning the PDO/PGI/TSG, instructions for appeal and the product specification on which the decision was based shall be published on the website of the Finnish Agency for Rural Affairs. A notification of a positive decision shall be published in the Official Gazette and the Trademark Gazette.

Section 3 Notification of the manufacture of a registered PDO/PGI/TSG product A food business operator that manufactures a PDO/PGI/TSG product shall provide notification of the name and place of manufacture of the product before placing the product on the market. Such notification may be provided in connection with the notifications under sections 13—15, 22 and 22 a of the Food Act or as a separate notification. The notification shall indicate the quality scheme under Regulation (EU) No 1151/2012 of the European Parliament and of the Council it concerns.

Section 4 Entry into force This Decree enters into force on 1 January 2015. This Decree repeals the Decree of the Ministry of Agriculture and Forestry on PDOs, PGIs and TSGs for agricultural products and foodstuffs (907/2007).
