This order is made under section 2 of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership Amendment Act 2018 on the advice and with the con- sent of the Executive Council and on the recommendation of the Minister for Trade and Export Growth.

1 Title This order is the Comprehensive and Progressive Agreement for Trans-Pacific Partnership Amendment Act 2018 Commencement Order 2018.

2 Commencement of CPTPP-related provisions The following provisions of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership Amendment Act 2018 come into force on 30 December 2018: (a) sections 3, 9 to 27, 29 to 37, 37A to 37G, 40(1), (2), (5), and (6), and

44(1) to (4) (which relate to the Copyright Act 1994): (b) section 44(9) (but only for the purpose of bringing into force the Part 2

heading, the subpart 2 heading, clauses 47 and 48 of Schedule 1, and the cross-headings above those clauses) (which relate to the Copyright Act 1994):

(c) Part 4 (which relates to the Hazardous Substances and New Organisms Act 1996):

(d) Part 5 (which relates to the Legislation Act 2012): (e) Part 6 (which relates to the Overseas Investment Act 2005): (f) sections 71 and 72 (which relate to the Patents Act 2013): (g) section 77 (but only for the purpose of bringing into force the Part 2

heading and clause 4 of Schedule 1AA) (which relates to the Patents Act 2013):

(h) Part 8 (which relates to the Tariff Act 1988): (i) sections 89, 90(2), and 91(2) (which relate to the Tariff): (j) Part 10 (which relates to the Trade Marks Act 2002): (k) Part 11 (which relates to the Wine Regulations 2006).

Explanatory note

This note is not part of the order, but is intended to indicate its general effect. This order brings into force, on 30 December 2018, the provisions that implement the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (the CPTPP). There are other provisions in the Comprehensive and Progressive Agreement for Trans-Pacific Partnership Amendment Act 2018 that are not brought into force by this order. Those provisions relate only to the Trans-Pacific Partnership Agreement (the TPP).
