I                              - A exclusividade da marca "Leite de Rosas" é violada pelo uso da expressão "Desodorante Creme de Rosas", mormente em embalagem semelhante

II                             - Embora composta por palavras comuns, a marca deve ter distinção suficiente no mercado de modo a nomear um produto específico. Marcas semelhantes em produtos da mesma classe induzem o consumidor a erro e violam direito do titular da marca original.

III                           - Recurso Especial provido.

ACÓRDÃO

Vistos, relatados e discutidos os autos em que são partes as acima indicadas, acordam os Ministros da Terceira Turma do Superior Tribunal de Justiça, por unanimidade, dar provimento ao recurso especial, nos termos do voto do(a) Sr(a). Ministro(a) Relator(a).
