Acuerdo y Sentencia Nº 502. Juicio: Juicio: EL TRIGAL S.A. c/ BAGLEY ARGENTINA S.A. s/ Nulidad de registro de marcas.

En fecha 11 de Julio de 1.986, la firma DISGAL S.A. solicitó la inscripción de la marca CHOCOCHIPS, en la Clase 30, ante el Centro Nacional de la Propiedad Industrial, Montevideo, Uruguay (fs. 13), el cual fue concedido el 27 de Septiembre de 1.988, Acta Nº 212631 (fs. 14). A fs. 18 consta que la firma DISGAL S.A. transfirió la marca CHOCOCHIPS a favor de El Trigal S.A., que solicitó la renovación del Registro, siendo concedida por Acta Nº 307403 hasta el 17/IX/2.008, conforme luce a fs. 17 y 25. Posteriormente, EL TRIGAL S.A. solicitó en nuestro país Registro de dicha marca, otorgándosele inscripción bajo el Registro Nº 160093, con vigencia desde el 24 de Febrero de 1.993 hasta el 24 de Febrero de 2.003 (fs. 100/1). La validez jurídica de dichos documentos fue expresamente reconocida por la contendiente, por lo que constituye prueba indubitable e inequívoca de que la actora desde el 27 de Septiembre de 1.988 es propietaria de la marca CHOCOCHIPS.
