The defendant [for person A] registered a figurative mark No M 76 342 (application of 10 November 2020), containing the word sign ‘Coffee friend’ and a drawing of the top of the mug with a smiley face in it for the services in Class 35 ‘trade in coffee beans’ and the services in Class 43 ‘rental of coffee machines’ of the Nice Classification. The applicant asked for this registration to be invalidated on the basis of earlier rights as relative grounds, i.e. the commercial sign ‘Kafijas draugs’ (‘Coffee friend’) of companies and services used in the same sector of economic activity, whose use in the economic circulation in Latvia had been commenced legally and in good faith prior to the date of the application for registration of the trade mark in 2014 (Article 10(1)(3) of the Trade Mark Law (TML), non-registered trade marks or a domain name used in good faith in economic circulation in Latvia in connection with identical or similar goods or services prior to the date of the application for registration of the applicant‘s trade mark for the duration and to the extent that the use of the registered trade mark may confuse consumers about the origin of the respective goods or services (Article 6(3) of the TML).
