The applicant, a collective management organisation of related rights, brought a claim of the simplified procedure against the defendant, who rents out three apartments on a short-term basis, for the prevention of the infringement of related rights, asking to recover damages for 2 months of the infringement of related rights in the amount of EUR 223.59. The action is based on the fact that the defendant, in her three apartments in Riga which are rented out on a short-term basis and include free Wi-Fi and a flat-screen television with satellite channels, enables tenants to listen to music without paying the applicant, as a collective management organisation of related rights, a fee for the use of phonograms (music recordings) instead of the public performance. The defendant denied infringement.
