Tal y como lo indicó la examinadora, de la solicitud de patente no se puede derivar que la nueva formulación propuesta posea un efecto sorprendente respecto de la enfermedad que pretende tratar, principalmente trastornos proliferativos como cáncer de vejiga, cáncer de páncreas, melanoma cutáneo o intraocular, cáncer de mama y cáncer de útero. Ante esta idea, el apelante indica que ese efecto sorprendente que vendría a justificar la altura inventiva proviene de la mayor solubilidad del compuesto proveniente de la específica fórmula reivindicada, sin embargo, quedó claramente explicado por parte de la examinadora al responder técnicamente el recurso de revocatoria que la forma de dosificación farmacéutica descrita en D1 aplica para todo ingrediente activo poco soluble en agua, sin importar si éste posee o no propiedades farmacológicas, por lo que será esperable su mejor solubilidad y biodisponibilidad, lo cual es conocido y pacífico en el estado del arte, siendo esperable su utilización para ABT-263.
