Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure

Communication by the European Patent Office Relating to a Change in the Fees Charged by the Deutsche Sammlung von Mikroorganismen und Zellkulturen GmbH (DSMZ)

The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify him of the receipt, on July 26, 2001, of a written communication, dated July 20, 2001, from the European Patent Office (EPO), relating to a change in the fees charged by the Deutsche Sammlung von Mikroorganismen und Zellkulturen GmbH (DSMZ), an international depositary authority under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, done at Budapest on April 28, 1977, as amended on September 26, 1980 (see Budapest Notification No. 22 of August 27, 1981). The text of that communication is attached.

The fees set forth in the said communication will apply as from January 1, 2002, and will replace the fees published in the November 1998 issue of the WIPO periodical Intellectual Property Laws and Treaties (see Budapest Notification No. 172 of November 30, 1998).

The notifications and information relating to the international depositary authorities under the Budapest Treaty and its Regulations will, as from the June/July issue, no longer be published in our periodical Intellectual Property Laws and Treaties, but will be published on WIPO's website.

COMMUNICATION

In accordance with Rule 12.2 of the Regulations under the Budapest Treaty, I have the honour to hereby notify you that the amounts of fees charged by the Deutsche Sammlung von Mikroorganismen und Zellkulturen GmbH (DSMZ) will be modified for the deposits of microorganisms relating to patent applications.

You will find, attached, the English and French versions of the fee schedule. I should be grateful if you could publish information on the above as soon as possible in your periodical Intellectual Property Laws and Treaties and let us know the publication date.

DSMZ - Deutsche Sammlung von Mikroorganismen und Zellkulturen GmbH
Change in the Fee Schedule

The DSMZ schedule of fees will be changed with effect from January 1, 2002, as follows:

1. (a) Storage according to Rule 12.1(a)(i) of the Regulations under the Budapest Treaty Euro
    - bacteria, fungi, plasmids, bacteriophages and plant viruses 750
    - plant cell cultures, human and animal cell cultures and murine embryos 1,350
  (b) Conversion of a deposit made outside the Budapest Treaty into a deposit according to the Budapest Treaty  
    - bacteria, fungi, plasmids, bacteriophages and plant viruses 750
    - plant cell cultures, human and animal cell cultures and murine embryos 1,350
  (c) Prolongation of the duration of the storage over the one provided by Rule 9 of the Regulations under the Budapest Treaty, per year  
    - bacteria, fungi, plasmids, bacteriophages and plant viruses 25
    - plant cell cultures, human and animal cell cultures and murine embryos 45
2. Issuance of viability statement under Rule 12.1(a)(iii) of the Regulations under the Budapest Treaty  
  (a) Where a viability test is requested 110
  (b) On the basis of the most recent viability test 45
3. Furnishing of a sample under Rule 12.1(a)(iv) of the Regulations under the Budapest Treaty (plus current freight costs) 110
4. Communication of information under Rule 7.6 of the Regulations under the Budapest Treaty 45

As a general rule, the fees under points 1, 2, 4 and 5 (services provided within the Federal Republic of Germany) are subject to VAT, currently at the rate of 7%, which is also payable where samples are furnished to requesting parties in the Federal Republic of Germany.

Turnover tax, again currently at the rate of 7%, must be charged on EU orders not quoting a VAT registration number.

A processing fee of 20 euro to cover bank charges is payable on all foreign invoices.
