The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify him of the deposit by the Government of the Republic of Indonesia, on June 5, 1997, of its instrument of accession to the Patent Cooperation Treaty (PCT), done at Washington on June 19, 1970, amended on September 28, 1979, and modified on February 3, 1984.
The said instrument of accession contains the following declaration:
"The Republic of Indonesia does not consider itself bound by the provision of Article 59 of the Treaty, which provides: 'Subject to Article 64(5), any dispute between two or more Contracting States concerning the interpretation or application of this Treaty or the Regulations, not settled by negotiation, may, by any one of the States concerned, be brought before the International Court of Justice by application in conformity with the Statute of the Court, unless the States concerned agree on some other method of settlement. The Contracting States bringing the dispute before the Court shall inform the International Bureau; the International Bureau shall bring the matter to the attention of the other Contracting States.' The Republic of Indonesia takes the position that for any dispute to be referred to the International Court of Justice for its decision, the agreement of all the Parties to the dispute shall be necessary in each individual case."
The said Treaty will enter into force, with respect to the Republic of Indonesia, on September 5, 1997.
