The applicant, Sigulda Municipality, owns a figurative trade mark No M 77 630 registered on 20 May 2022 (application date 28 December 2021), namely, the orange letter ‘S’ with an exclamation mark (‘S!’) for the goods in Class 16, including paper or cardboard signs, paper advertisements, printed matter, printed privilege cards, teaching and visual aids, as well as services in Class 35, including sale of advertisements, souvenirs, food products and accessories. The defendant’s political party ‘Stabilitātei!’ (‘For Stability!’) uses the sign ‘S!’ in a similar typeface in orange on identical goods and services as the applicant, namely, in advertising and on representation materials.
