1. Short title
This Act may be cited as the Consumer Protection (Amendment) Act 2009.
2. Amendment of section 5(1) of the Consumer Protection Act 2001
Section 5(1) of the Consumer Protection Act 2001 is amended by repealing “The Beretitenti, acting in accordance with the advice of the Public Service Commission” and substituting “Subject to section 99 of the Constitution, the Minister”.
CONSUMER PROTECTION (AMENDMENT) ACT 2009
EXPLANATORY MEMORANDUM
Section 2 of this short Act amends section 5(1) of the Consumer Protection Act 2001, to change the procedure by which inspectors are appointed. At present inspectors are appointed by the Beretitenti, acting in accordance with the advice of the Public Service Commission. Given that inspectors will ordinarily be persons already appointed to the civil service, it is considered that further reference to the Public Service Commission adds an unnecessary administrative step to the appointment process. This amendment brings the Act into line with similar provisions in the Prices Ordinance (Cap.75). The reference to section 99 of the Constitution safeguards against any misconceptions as to the extent of the appointment power.
