supplementing the Annex to Regulation (EC) No 2400/96 on the entry of certain names in the Register of protected designation of origin and protected geographical indications provided for in Council Regulation (EEC) No 2081/92 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs ‘Φοινίκι Λακωνίας’ (Finiki Lakonias)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EEC) No 2081/92 of 14 July 1992 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs (¹), as last amended by Regulation (EC) No 806/2003 (²), and in particular Article 6(3), (4) and (5) thereof,

Whereas:

(1): Under Article 5 of Regulation (EEC) No 2081/92, Greece has sent the Commission an application for the registration of the name ‘ΦΟΙΝΙΚΙ ΛΑΚΩΝΙΑΣ’ (Finiki Lakonias) as a protected designation of origin.
(2): In accordance with Article 6(1) of that Regulation, the application has been found to meet all the requirements laid down therein and in particular to contain all the information required in accordance with Article 4 thereof.
(3): A statement of objection has been received by the Commission from Italy under Article 7 of that Regulation following publication in the Official Journal of the European Communities (³). This statement of objection concerning the provision in the product specification allowing bottling to take place outside the defined geographical area was not found admissible within the meaning of Article 7(4) of Regulation (EEC) No 2081/92 as it did not show non-compliance with the conditions referred to in Article 2 of that Regulation. No other statement of objection has been notified to the Commission in respect of the name Φοινίκι Λακωνίας (Finiki Lakonias) following its publication in the Official Journal of the European Communities.

(4): The name should therefore be entered in the Register of protected designations of origin and protected geographical indications and hence be protected throughout the Community as a protected designation of origin.
(5): The Annex to this Regulation supplements the Annex to Commission Regulation (EC) No 2400/96 (⁴), as last amended by Regulation (EC) No 1291/2003 (⁵).
(6): The measures provided for in this Regulation are in accordance with the opinion of the Committee established under Article 15 of Regulation (EEC) No 2081/92,

HAS ADOPTED THIS REGULATION:

Article 1

The name in the Annex hereto is added to the Annex to Regulation (EC) No 2400/96 and entered as a protected designation of origin (PDO) in the Register of protected designations of origin and protected geographical indications provided for in Article 6(3) of Regulation (EEC) No 2081/92.

Article 2

This Regulation shall enter into force on the 20th day following its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

LA COMISIÓN DE LAS COMUNIDADES EUROPEAS,

Visto el Tratado constitutivo de la Comunidad Europea,

Visto el Reglamento (CEE) n^o2081/92 del Consejo, de 14 de julio de 1992, relativo a la protección de las indicaciones geográficas y de las denominaciones de origen de los productos agrícolas y alimenticios (¹), cuya última modificación la constituye el Reglamento (CE) n^o806/2003 (²), y, en particular, los apartados 3, 4 y 5 de su artículo 6,

Considerando lo siguiente:

(1): En virtud del artículo 5 del Reglamento (CEE) n^o2081/ 92, Grecia ha transmitido a la Comisión una solicitud de registro del nombre «Φοινίκι Λακωνίας» («Finiki Lakonias») como denominación de origen protegida.
(2): De conformidad con lo dispuesto en el apartado 1 del artículo 6 de dicho Reglamento, se ha comprobado que la solicitud cumple todos los requisitos establecidos en el citado Reglamento y, concretamente, que contiene todos los datos previstos en su artículo 4.
(3): Tras la publicación de la denominación en el Diario Oficial de las Comunidades Europeas (³), la Comisión recibió una declaración de oposición de Italia presentada al amparo del artículo 7 del Reglamento. Esa declaración de oposición, referida a la especificación del producto que permite embotellarlo fuera de la zona geográfica delimitada, no cumplía las condiciones indicadas en el artículo 2 del Reglamento (CEE) n^o2081/92, por lo que la Comisión la desestimó con arreglo a lo dispuesto en el apartado 4 del artículo 7 de ese Reglamento. La Comisión no ha recibido ninguna declaración de oposición más con respecto a la denominación «Φοινίκι Λακωνίας (Finiki Lakonias)» tras su publicación en el Diario Oficial de las Comunidades Europeas.

(4): Por consiguiente, esta denominación puede inscribirse como denominación de origen protegida en el Registro de Denominaciones de Origen Protegidas y de Indicaciones Geográficas Protegidas y, como tal, ser protegida en toda la Comunidad.
(5): El anexo del presente Reglamento completa el del Reglamento (CE) n^o2400/96 de la Comisión (⁴), cuya última modificación la constituye el Reglamento (CE) n^o1291/ 2003 (⁵).
(6): Las medidas previstas en el presente Reglamento se ajustan al dictamen del Comité creado en aplicación del artículo 15 del Reglamento (CEE) n^o2081/92.

HA ADOPTADO EL PRESENTE REGLAMENTO:

Artículo 1

El anexo del Reglamento (CE) n^o2400/96 se completa mediante la denominación que figura en el anexo del presente Reglamento, que queda inscrita como denominación de origen protegida (DOP) en el Registro de Denominaciones de Origen Protegidas y de Indicaciones Geográficas Protegidas contemplado en el apartado 3 del artículo 6 del Reglamento (CEE) n^o2081/92.

Artículo 2

El presente Reglamento entrará en vigor el vigésimo día siguiente al de su publicación en el Diario Oficial de la Unión Europea.

El presente Reglamento será obligatorio en todos sus elementos y directamente aplicable en cada Estado miembro.

LA COMMISSION DES COMMUNAUTÉS EUROPÉENNES,

vu le traité instituant la Communauté européenne,

vu le règlement (CEE) n^o2081/92 du Conseil du 14 juillet 1992 relatif à la protection des indications géographiques et des appellations d'origine des produits agricoles et des denrées alimentaires (¹), modifié en dernier lieu par le règlement (CE) n^o806/2003 (²), et notamment son article 6, paragraphes 3, 4 et 5,

considérant ce qui suit:

(1): Conformément à l'article 5 du règlement (CEE) n^o2081/ 92, la Grèce a transmis à la Commission une demande d'enregistrement en tant qu'appellation d'origine protégée pour la dénomination «Φοινίκι Λακωνίας» («Finiki Lakonias»).
(2): Il a été constaté, conformément à l'article 6, paragraphe 1, dudit règlement, que la demande est conforme au règlement, et notamment qu'elle comprend tous les éléments prévus en son article 4.
(3): À la suite de la publication au Journal officiel des Communautés européennes (³), une déclaration d'opposition a été transmise à la Commission par l'Italie au titre de l'article 7 du règlement. Cette déclaration d'opposition, relative à la disposition du cahier des charges autorisant l'embouteillage en dehors de la zone géographique définie, n'a pas été considérée comme recevable au sens de l'article 7, paragraphe 4, car elle ne démontrait pas le non-respect des conditions visées à l'article 2 du règlement. Aucune autre déclaration d'opposition n'a été notifiée à la Commission en ce qui concerne la dénomination «Φοινίκι Λακωνίας» («Finiki Lakonias») à la suite de sa publication au Journal officiel des Communautés européennes.

(4): Cette dénomination mérite d'être inscrite dans le «Registre des appellations d'origine protégées et des indications géographiques protégées», et donc d'être protégée sur le plan communautaire en tant qu'appellation d'origine protégée.
(5): L'annexe du présent règlement complète l'annexe du règlement (CE) n^o2400/96 de la Commission (⁴), modifié en dernier lieu par le règlement (CE) n^o1291/2003 (⁵).
(6): Les mesures prévues par le présent règlement sont conformes à l'avis du comité institué en vertu de l'article 15 du règlement (CEE) n^o2081/92,

A ARRÊTÉ LE PRÉSENT RÈGLEMENT:

Article premier

L'annexe du règlement (CE) n^o2400/96 est complétée par la dénomination figurant à l'annexe du présent règlement et cette dénomination est inscrite dans le «Registre des appellations d'origine protégées et des indications géographiques protégées», prévu à l'article 6, paragraphe 3, du règlement (CEE) n^o2081/ 92, en tant qu'appellation d'origine protégée (AOP).

Article 2

Le présent règlement entre en vigueur le vingtième jour suivant celui de sa publication au Journal officiel de l'Union européenne.

Le présent règlement est obligatoire dans tous ses éléments et directement applicable dans toutÉtat membre.
