Chapter I General provisions
Section 1 Definitions
For the purposes of this Act: - (1)
- ”layoutdesign” means the threedimensional pattern of the elements of an integrated circuit, however implemented or expressed, and
- (2)
- ‘integrated circuit’ means a circuit in which the elements, at least one of which is an active element, and some or all of the interconnections between them, have been placed on a semiconductor substrate to form a functional entity and which is intended to perform electronic circuitry functions.
Section 2 Originality of layoutdesign
This Act shall not apply to a layoutdesign or a part thereof that is not original.
Section 3 Obtaining an exclusive right
Anyone who has created a layoutdesign, or to whom the right of the creator of a layoutdesign has been transferred, may obtain an exclusive right in the layoutdesign by registration.
If a layoutdesign has been created within the scope of duties in an employment situation, the employer shall be entitled, unless
