I. GENERAL PROVISIONS

SUBJECT MATTER OF THE PROTECTION

Article 1 This Act regulates the protection of topographies of semiconductor products.

DEFINITIONS Article 2

For the purposes of this Act:

(1) A Semiconductor product means the final or an intermediate form of any product:

a) Consisting of a body of material which includes a layer of semiconducting material, and

b) Having one or more other layers composed of conducting, insulating or semiconducting material which have been arranged in accordance with a predetermined three-dimensional pattern, and

c) Intended to perform an electronic function, exclusively or together with other functions.

(2) The topography of a semiconductor product (hereinafter: topography) means a series of related images, however fixed or encoded:

a) Representing the three-dimensional pattern of the layers of which a semiconductor product is composed, and

b) In which series each image has the pattern or part of the pattern of a surface of the semiconductor product at any stage of its manufacture.

(3) Commercial exploitation of a topography means the sale, rental, leasing or any other method of commercial distribution of the topography, including its offer for any of these purposes. First commercial exploitation shall not include exploitation under conditions of confidentiality to the extent that no further distribution to third parties occurs.

II. PROTECTION REQUIREMENTS AND RIGHT

TO PROTECTION

PROTECTION REQUIREMENTS Article 3

(1) The topography shall be protected by an exclusive right in accordance with the provisions of this Act if it is the result of its creator's own intellectual effort and is not commonplace in the semiconductor industry.

(2) Where the topography consists of elements that are commonplace in the semiconductor industry, it shall be protected only to the extent that the combination of such elements, taken as a whole, fulfils the conditions referred to in paragraph (1) of this Article.

RIGHT TO PROTECTION Article 4

(1) Right to protection shall apply in favour of natural persons who are the creators of the topographies. Where several persons have jointly created a topography, the right shall jointly apply in favour of all of them.

(2) Where a topography is created in the course of the creator's employment, the right to protection shall apply in favour of the creator's employer unless otherwise provided by the employment contract.

(3) Where a topography is created under a contract other than a contract of employment, the right to protection shall apply in favour of a party to the contract by whom the topography has been commissioned, unless otherwise provided by the contract.

(4) Where a topography is created in accordance with paragraphs (2) and (3) of this Article, the right to protection of a topography shall apply in favour of:

a) Natural persons who are nationals of the Republic of Croatia or who have their domicile or habitual residence on the territory of the Republic of Croatia;

b) Companies or other legal persons who have their principle place of business on the territory of the Republic of Croatia.

(5) The right to protection shall also apply in favour of the successors in title of the persons mentioned in paragraphs (1) to (4) of this Article.

Article 5 Foreign legal and natural persons not having their principle place of business, or a domicile or a habitual residence on the territory of the Republic of Croatia shall enjoy the protection provided by this Act, if it results from international treaties binding the Republic of Croatia or from the application of the principle of reciprocity.

III. THE REGISTRATION PROCEDURE

COMMON PROVISIONS ON THE PROCEDURE BEFORE THE OFFICE

Article 6 (1) The procedures for registration and

declaration of the decision on the registration of a topography null and void shall be carried out by the State Intellectual Property Office of the Republic of Croatia (hereinafter: the Office).

(2) Against the decisions made by the Office no appeal shall be allowed, but an administrative lawsuit may be initiated.

(3) The Act on General Administrative Procedure shall apply to certain matters concerning the procedure which are not regulated by this Act.

FILING OF THE APPLICATION Article 7

(1) The procedure for registration of a topography shall be initiated by an application containing a request for the registration of topography and other relevant elements prescribed by this Act (hereinafter: topography application).

(2) A topography application shall contain: a) A request for the registration of a

topography, which must clearly and concisely identify the topography by its name or specification of the product range,

b) Indications allowing the identity of the applicant to be established,

c) Sufficient data to contact the applicant or his representative, if any, by mail,

d) Written statement as to the date of the first commercial exploitation if that date occurred before the filing date of the application,

e) Data and supplements identifying the topography:

i) Drawings or photographs of layouts for the production of a semiconductor product, or

ii) Drawings or photographs of layouts or the parts thereof for the production of semiconductor product, or

iii) Drawings or photographs of individual layers of the semiconductor product.

(3) The following may be attached to the material referred to in paragraph (2) (e) of this Article: data carriers, their printouts, the semiconductor product for the topography of which the registration is applied for, or a detailed description.

(4) A separate application shall be filed for each topography.

(5) The Minister responsible for the work of the Office, upon the proposal made by the Director of the Office, shall enact the Regulations defining the form of the application and the manner of drafting and filing thereof.

Article 8 (1) The applicant has the right to mark any of

the required materials or any of the parts thereof as a trade secret, in which case these parts shall not be made available to the public.

(2) The court may order the disclosure of the materials referred to in paragraph (1) of this Article only to persons involved in litigation concerning the validity or infringement of the exclusive rights referred to in Article 14 of this Act.

EXAMINATION OF TOPOGRAPHY APPLICATION

Article 9 (1) The Office shall examine whether the filed

topography application contains all the elements referred to in Article 7, paragraph (2) of this Act.

(2) If the application does not contain all the elements referred to in Article 7, paragraph (2) of this Act, the Office shall invite the applicant to remedy the deficiencies within a time limit, which shall not be shorter than one month and not longer than three months.

(3) If the applicant remedies all the deficiencies within the time limit referred to in paragraph (2) of this Article, the date of receipt of the correct application shall be deemed as the filing date of the application.

(4) If the applicant does not remedy all the deficiencies within the time limit referred to in paragraph (2) of this Article, the Office shall reject the application by a decision.

REGISTRATION OF TOPOGRAPHY AND PUBLICATION OF THE REGISTERED

TOPOGRAPHY Article 10

(1) If the application contains all the elements referred to in Article 7, paragraph (2) of this Act, the Office shall issue to the applicant a decision on the registration of the topography.

(2) The topography shall be entered in the register of topographies and the data from the register shall be published in the Official Gazette of the Office.

REGISTER OF TOPOGRAPHIES Article 11

(1) The register of topographies shall be kept by the Office.

(2) The register referred to in paragraph (1) of this Article shall be public.

(3) For each topography the following data shall be entered in the register of topographies: a) Registration number of the

topography, b) Filing date of the application,

c) Date and number of the decision on the entry into the register,

d) Name of the topography,

e) Data on the applicant: the family name and the first name, as well as the domicile, and the nationality of the

applicant, if it is a natural person, or the name and principle place of business of the applicant if it is a legal entity, whereas the data concerning legal entities shall correspond to those contained in the court register,

f) Data on the creator: the family name, the first name and the title; the indication of the town and the country shall be sufficient,

g) Date of the first commercial exploitation of the topography, if the topography has already been commercially exploited,

h) Data on a representative, if any,

i) Data on changes referring to: the transfer of the right, license, declaration of nullity, expiration and other changes relevant for the legal status of the registered topography.

(4) The Minister responsible for the work of the Office, upon the proposal made by the Director of the Office, shall enact the Regulations prescribing the form and the manner of keeping the register of topographies.

PAYMENT OF THE ADMINISTRATIVE FEES AND PROCEDURAL CHARGES

Article 12 (1) The acts performed in the course of the

administrative procedure for the registration of a topography shall be subject to the payment of the fees in compliance with special regulations.

(2) Should the prescribed fees not be paid within the prescribed time limit, the application shall be deemed withdrawn.

DECLARATION OF THE DECISION ON THE REGISTRATION OF A TOPOGRAPHY

NULL AND VOID Article 13

(1) The decision on the registration of a topography shall be declared null and void if it has been established:

a) That the topography does not meet the requirements referred to in Article 3, paragraph (1) of this Act,

b) That the application was filed by a natural person or a legal entity not entitled to the protection,

c) That the application was not filed within the prescribed terms referred to in Article 19 of this Act,

d) That the identification of the registered topography is not possible on the basis of layouts relating to it.

(2) The procedure relating to the declaration of the decision on the registration of a topography null and void may be initiated by the Office ex officio, or upon the proposal of any natural person or legal person or by the state attorney on the grounds prescribed in paragraph (1) of this Article, during the entire duration of the validity of a topography.

IV. EFFECTS OF PROTECTION AND LIMITATIONS

EXCLUSIVE RIGHTS Article 14

(1) The exclusive rights referred to in Article 3 of this Act shall include the right to authorize or prohibit any of the following acts:

a) Reproduction of the topography, b) Import, sale or other forms of putting

into circulation the topography or the semiconductor product manufactured by using the protected topography, as well as the products incorporating the semiconductor product containing the protected topography.

(2) The exclusive rights referred to in paragraph (1) of this Article shall not apply to any concept, process, system, technique of production of the topography, or any information embodied in the topography, but to the topography as such.

LIMITATIONS OF EXCLUSIVE RIGHTS Article 15

Without the authorisation of the holder of the exclusive rights conferred by a protected topography, the following shall be permitted:

(1) Reproduction of the protected topography for private purposes and non-commercial aims,

(2) Reproduction of the protected topography for the purpose of analysing, evaluating or teaching the concepts, processes, systems

and techniques embodied in the topography or the topography itself, and

(3) Commercial exploitation of a new topography which has been created on the basis of research and analysis of the protected topography which is a result of personal creative effort of its creator and is not commonplace in the semiconductor industry.

Article 16 (1) A person who, when he acquires a

semiconductor product, does not know, or has no reasonable grounds to believe, that the product is protected by the exclusive rights conferred by protected topography, shall not be prevented from commercially exploiting that product.

(2) For the commercial exploitation of a semiconductor product occurring after the person referred to in paragraph (1) of this Article has known, or has reasonable grounds to believe, that the product is protected by the exclusive rights conferred by a protected topography, an adequate remuneration shall be determined by the court unless the parties resolve the issue by negotiation, mediation, or binding arbitration.

(3) The provisions of paragraphs (1) and (2) of this Article shall also apply to the successors in title of the person who has acquired a semiconductor product protected by the exclusive rights conferred by a protected topography.

EXHAUSTION OF RIGHTS Article 17

The exhaustion of the exclusive rights to authorise or prohibit the acts specified in Article 14 paragraph (1) of this Act shall come into effect at the moment of putting the protected topography or the semiconductor product produced by using the protected topography on the market in Republic of Croatia by the holder of the exclusive rights conferred by the protected topography or with his authorisation.

V. DURATION OF EXCLUSIVE RIGHTS

COMING INTO EXISTENCE OF EXCLUSIVE RIGHTS

Article 18 The exclusive rights conferred by a protected topography shall come into existence on the earlier of the following dates: 1. The date when the topography is first

commercially exploited anywhere in the world, or

2. The date when an application for registration has been filed to the Office in due form.

EXPIRY OF EXCLUSIVE RIGHTS Article 19

(1) The exclusive rights shall come to an end upon the expiry of a 10 year period from the earlier of the following dates:

a) The end of the calendar year in which the first commercial exploitation of the topography has started anywhere in the world; or

b) The end of the calendar year in which the application for the registration of the topography has been filed in due form.

(2) Where a topography has not been commercially exploited anywhere in the world, any exclusive rights in existence shall expire within 15 years from its first fixation or encoding, unless an application for registration in due form has been filed within that period.

Article 20 An application for the registration of a topography shall not be filed after the expiration of a period of two years as from date on which the first commercial exploitation of the topography has started.

MARKING OF TOPOGRAPHY Article 21

During the existence of the exclusive rights, the holder of a registered topography shall have the right to mark a semiconductor product produced by using the registered topography with a capital letter “T”.

VI. CIVIL PROTECTION

Article 22 (1) A holder of the exclusive rights conferred

by the protected topography whose rights have been infringed may claim, in addition to the compensation for damages, the ordering of measures to prevent further infringement of his exclusive rights.

(2) A person infringing the exclusive rights conferred by the protected topography shall be liable to compensate for the damage incurred, in accordance with the general principles on the compensation for damages.

(3) The provision referred to in paragraph (1) of this Article shall also apply to the successors in title of the holder of the protected topography.

VII. TRANSITIONAL AND FINAL PROVISIONS

Article 23 The provisions of the Patent Act concerning the representation, the holders of the joint rights to a protected topography, the procedure for the declaration of the decision on the registration of a topography null and void, the time limits for bringing civil action on the grounds of the infringement of the right, the transfer of the right, and licence agreements shall apply mutatis mutandis to the topographies of semiconductor products which are the subject matter of this Act.

Article 24 The provisions of this Act shall apply only to the topographies created after its entry into force.

Article 25 Upon the proposal made by the Director of the Office, the Minister responsible for the work of the Office shall enact the Regulations prescribing the matters referred to in Article 7, paragraph (5) and Article 11, paragraph (4) of this Act up to the date the application of this Act shall start.

Article 26 The Act on the Protection of the Layout-Designs of Integrated Circuits (Official Gazette Nos. 78/99 and 127/99) shall cease to be in force on the date the application of this Act starts.

Article 27 This Act shall enter into force on the eighth day from the day of its publication in the Official Gazette, and shall be applied as of 1 January 2004.

ACT AMENDING AND SUPPLEMENTING THE PROTECTION OF TOPOGRAPHIES OF SEMICONDUCTOR PRODUCTS ACT*

Article 1 In the Protection of Topographies of Semiconductor Products Act (Official Gazette No. 173/03), in Article 4, following the paragraph 4 a new paragraph 5 is added to read: “(5) Where the right to protection does not exist pursuant to other provisions of this Article, the right to protection of a topography shall also apply in favour of the persons referred to in paragraph 4, subparagraphs a) and b) of this Article, if: a) they have first commercially exploited in the territory of the Republic of Croatia a topography, which has not previously been commercially exploited anywhere in the world, b) they have been exclusively authorized to commercially exploit a topography in the European Union by the person entitled to transfer the rights in it.” In present paragraph 5, which shall be renumbered into paragraph 6, number “4” shall be replaced by number “5”.

Article 2 Article 6 is amended to read: “(1) The Office shall carry out the administrative proceedings for registration of a topography and declaration of the decision on the registration of a topography null and void, and perform other administrative and professional tasks concerning the protection of the topographies of semiconductor products. (2) The administrative decisions rendered by the Office in the first instance may be appealed and the appeals shall be decided on by the Board of Appeal in accordance with the provisions of this Act. (3) The provisions of the General Administrative Proceedings Act shall apply to particular matters concerning the procedure referred to in paragraphs 1 and 2 of this Article, not regulated by this Act. (4) The administrative decisions rendered by the Board of Appeal in the second instance may be challenged in the administrative dispute according to the Administrative Dispute Act.”

Article 3 Article 11, paragraph 4 is deleted.

Article 4 In article 12, paragraph 1, a second sentence is added to read:

“If the prescribed administrative fee and procedural charges have not been paid within the prescribed time limit, the application shall be considered as withdrawn.” Paragraph 2 is amended to read: “(2) The filing of an appeal shall be subject to payment of the administrative fee and procedural charges in accordance with special regulations. If the administrative fee and procedural charges have not been paid before the expiry of the appeal period, the appeal shall not be considered as filed.”

Article 5 Article 17 is amended to read: “The placing on the market in the territory of the Republic of Croatia, or following the accession of the Republic of Croatia to the European Union in the territory of a European Union Member State or a Contracting State of the Agreement creating the European Economic Area, of a protected topography or a semiconductor product manufactured by using the protected topography by the holder of the exclusive right conferred by the protected topography or with his/her express authorization, shall exhaust for the territory of the Republic of Croatia, the exclusive rights conferred by the protected topography.”

Article 6 Article 23 is amended to read: “The provisions of the Patent Act concerning the representation, the holders of the joint rights, the procedure for the declaration of nullity, the bringing the claim because of the infringement of rights, the claim for establishing the infringement and its termination, the claim for damages, the proceedings concerned with the infringement of rights, other matters concerning the civil enforcement of rights, the transfer of rights, the licence contracts, the appeal, the appeal proceedings, the Board of Appeals, and the administrative dispute, shall apply mutatis mutandis to the topographies of semiconductor products regulated by this Act.”

TRANSITORY AND FINAL PROVISIONS Article 7

The procedures concerning the protection of rights conferred by the registered topography of a semiconductor product, pending on the date of the entry into force of this Act, shall be completed pursuant to the provisions of the Act which was in force before the entry into force of this Act.

Article 8 The Regulations referred to in Article 25 of the Protection of Topographies of Semiconductor Products Act (Official Gazette No. 173/03) shall be harmonised with the provisions of this Act by the Minister responsible for the work of the Office, at the proposal of the Director General of the Office, not later than within three months following the entering into effect of this Act.

Article 9 This Act shall enter into force on the eight day following the day of its publication in the Official Gazette, except for: - the provisions of Article 1 of this Act

which shall enter into force on the day of accession of the Republic of Croatia in the European Union and

- the provisions of Article 2 of this Act which enter into force on 1 June 2008.

SEMICONDUCTOR PRODUCTS**

Article 1 In the Act on amendments to the Act on the protection of topographies of semiconductor products (OG 173/03 and 76/07) in Article 14, paragraph 1, item b), the words: “import, sale or any other way of placing on the market”, are replaced by the words: “commercial exploitation or import for these purposes”.

Article 2 Article 17 is amended, which reads: “The exclusive rights for granting authorisation or ban of actions referred to in article 14, paragraph 1, item b) of this Act, shall exhaust for the territory of the Republic of Croatia, after the protected topography or semiconductor product, manufactured by applying the protected topography, is placed on the market in the territory of the Republic of Croatia, or upon the accession of the Republic of Croatia to the European Union respectively, on the territory of any of the Member States, or contracting state party to the Treaty on the European Economic Area, respectively, by a person empowered to authorise commercial exploitation of a topography, or any other person with his/hers authorisation”.

TRANSITIONAL AND FINAL PROVISIONS

Article 3 This Act shall enter into force on the eighth day following the publication in the “Official Gazette”.

SEMICONDUCTOR PRODUCTS***

Article 1 In the Act on the Protection of Topographies of Semiconductor Products (“Official Gazette” Nos. 173/03 and 76/07), in Article 6, paragraph (2), the words “administrative decisions” are replaced by the word “decisions”. Paragraph (3) is deleted. In the former paragraph (4), which becomes paragraph (3), the words “administrative decisions” are replaced by the word “decisions”.

Article 2 In Article 9 paragraph (2), the words “shall invite the applicant” are replaced by the words “shall order the applicant by a conclusion” In paragraph (4), the Croatian word translated as “by a decision” is replaced by another Croatian word translated as “by a decision”.

Article 3 In Article 12 paragraph (1), the second sentence is deleted. In paragraph (2), the second sentence is deleted.

Article 4 This Act shall enter into force on the eighth day following the day of the publication thereof in the “Official Gazette”.

ACT ON AMENDMENTS TO THE ACT ON THE PROTECTION OF TOPOGRAPHIES OF SEMICONDUCTOR PRODUCTS****

Article 1 In the Act on the Protection of Topographies of Semiconductor Products (»Official Gazette«, No. 173/03, 76/07, 30/09 and 49/11), Article 6 shall be amended to read: »(1) The State Intellectual Property Office (hereinafter: the Office) shall carry out the administrative proceedings for registration of a topography and declaration of the decision on the registration of a topography null and void, and perform other administrative and professional tasks concerning the protection of the topographies of semiconductor products. (2) The decisions issued by the Office cannot be appealed, but an administrative dispute can be instituted before the Administrative Court in Zagreb. (3) The procedure referred to in paragraph (2) of this Article is urgent.«.

Article 2 In Article 12, paragraph (2) shall be deleted.

Article 3 After the word: »contracts« in Article 23, the comma and the words: »the appeal, the appeal proceedings, the Boards of Appeal,« shall be deleted.

TRANSITIONAL AND FINAL PROVISIONS Article 4

The Minister responsible for supervision of the work of the State Intellectual Property Office shall harmonise the Regulations on the Protection of Topographies of Semiconductor Products (»Official Gazette«, No. 72/04, 117/07 and 43/17) with the provisions of this Act within 30 days from the day of the entry into force of this Act.

Article 5 (1) Administrative procedures instituted by the provisions of the Act on the Protection of Topographies of Semiconductor Products (»Official Gazette«, No. 173/03, 76/07, 30/09 and 49/11) where the State Intellectual Property Office as the first instance authority issued the decision until the day of the entry into force of this Act shall be completed in accordance with the provisions of that Act and the regulations issued pursuant to that Act. (2) Boards of Appeal in the field of industrial property rights established and appointed on the basis of the Patents Act (»Official Gazette«, No. 173/03, 54/05, 87/05, 76/07, 30/09, 128/10, 49/11 and 76/13) shall continue to operate in accordance with the provisions of that Act and the regulations issued pursuant to that Act until all the administrative procedures referred to in paragraph (1) of this Article are completed by reaching final decisions, after which they shall cease to operate. (3) If, because of dismissal of the president or members of the Boards of Appeal referred to in paragraph (2) of this Article, it is not possible to determine the Board of Appeal to decide on an appeal, the procedure of electing or appointing the president or necessary number of members of the Boards of Appeal can exceptionally be conducted in accordance with the provisions of the Patents Act (»Official Gazette«, No. 173/03, 54/05, 87/05, 76/07, 30/09, 128/10, 49/11 and 76/13), for the needs of resolving the case referred to in paragraph (1) of this Article.

Article 6 This Act shall enter into force on the eighth day following the day of its publication in the »Official Gazette«.

PRAVO NA ZAŠTITU

Članak 4. (1) Pravo na zaštitu topografije imaju fizičke osobe

koje su njezini stvaratelji. Kada je više osoba zajednički stvorilo topografiju, pravo na zaštitu imaju svi stvaratelji zajedno.

(2) Kada je topografija stvorena u radnom odnosu, pravo na zaštitu ima poslodavac stvaratelja topografije, ako ugovorom o radu nije drukčije određeno.

(3) Kada je topografija stvorena na temelju ugovora različitog od ugovora o radu, pravo na zaštitu ima stran- ka tog ugovora koja je topografiju naručila, ako takvim ugovorom nije drukčije određeno.

(4) Kada je topografija stvorena u skladu sa stavkom 2. i 3. ovoga članka, pravo na zaštitu imaju:

a) fizičke osobe koje su državljani Republike Hrvat- ske ili na teritoriju Republike Hrvatske imaju prebivalište ili uobičajeno boravište,

b) trgovačka društva i druge pravne osobe koje imaju sjedište na teritoriju Republike Hrvatske.

(5) Pravo na zaštitu također pripada pravnim sljednicima osoba navedenih u stavku 1. – 4. ovoga članka.

Članak 5. Strane pravne i fizičke osobe koje nemaju sjedište,

odnosno prebivalište ili uobičajeno boravište na teritoriju Republike Hrvatske uživaju zaštitu predviđenu ovim Zakonom, ako to proizlazi iz međunarodnih ugovora koji obvezuju Republiku Hrvatsku ili iz primjene načela uzajamnosti.

III. POSTUPAK ZA REGISTRACIJU

ZAJEDNIČKE ODREDBE O POSTUPKU PRED ZAVODOM

Članak 6. (1) Postupak za registraciju i proglašenje ništavim

rješenja o registraciji topografije provodi Državni zavod za intelektualno vlasništvo Republike Hrvatske (u daljnjem tekstu: Zavod).

(2) Protiv odluka Zavoda nije dopuštena žalba, ali se može pokrenuti upravni spor.

(3) Za pojedina pitanja iz postupka koja nisu uređena ovim Zakonom primjenjuje se Zakon o općem upravnom postupku.

PODNOŠENJE PRIJAVE TOPOGRAFIJE

Članak 7. (1) Postupak za registraciju topografije pokreće se

prijavom koji sadržava zahtjev za registraciju topografije

ZAKON O ZAŠTITI TOPOGRAFIJA POLUVODIČKIH PROIZVODA

I. OPĆE ODREDBE

PREDMET ZAŠTITE

Članak 1. Ovim se Zakonom uređuje zaštita topografija

poluvodičkih proizvoda.

ODREĐENJE POJMOVA

Članak 2. Za potrebe ovoga Zakona: 1. Poluvodički proizvod označava završni ili

prijelazni oblik bilo kojeg proizvoda: a) koji se sastoji od materijala koji uključuje sloj

poluvodljivog materijala, i b) koji ima jedan ili više drugih slojeva sastavljenih

od vodljivog, izolacijskog ili poluvodljivog materijala razmještenih u skladu s unaprijed utvrđenim trodimen- zionalnim uzorkom, i

c) koji je namijenjen izvođenju elektroničke funkcije, isključivo ili zajedno s drugim funkcijama.

2. Topografija poluvodičkog proizvoda (u daljnjem tekstu: topografija) označava niz odgovarajućih slika, koja je nepromjenljivo oblikovana ili kodirana na bilo koji način, i:

a) koja predstavlja trodimenzionalni uzorak slojeva od kojih je poluvodički proizvod sastavljen, i

b) u kojem nizu svaka slika prikazuje uzorak ili dio uzorka površine poluvodičkog proizvoda na bilo kojem stupnju njegove izradbe.

3. Komercijalno iskorištavanje topografije označava prodaju, iznajmljivanje, davanje u zakup ili bilo koji drugi način komercijalne distribucije topografije, uključujući i nuđenje u te svrhe. Prvo komercijalno iskorištavanje topografije ne uključuje njeno iskorištavanje pod uvjetima povjerljivosti ako se njena daljnja distribucija ne vrši trećim osobama.

II. UVJETI ZAŠTITE I PRAVO NA ZAŠTITU

UVJETI ZAŠTITE

Članak 3. (1) U skladu s odredbama ovoga Zakona topografija

se štiti isključivim pravima ako je rezultat vlastitoga intelektualnog napora njezina stvaratelja i ako nije uobičajena u industriji poluvodiča.

(2) Ako se topografija sastoji od elemenata koji su uobičajeni u industriji poluvodiča, ona se štiti samo u opsegu u kojem kombinacija takvih elemenata, uzevši u cjelini, ispunjava uvjete iz stavka 1. ovoga članka.

i druge bitne sastojke propisane ovim Zakonom (u daljnjem tekstu: prijava topografije).

(2) Prijava topografije treba sadržavati: a) zahtjev za registraciju topografije, koji mora

jasno i sažeto označavati topografiju navođenjem naziva topografije ili pobližim označavanjem područja poluvodičkog proizvoda,

b) podatke dostatne za utvrđivanje tko je podnositelj prijave,

c) podatke dostatne za uspostavu veze s podnositeljem prijave ili njegovim zastupnikom, ako ga ima, poštom,

d) pisanu izjavu o datumu prve komercijalne uporabe ako je taj datum nastupio prije datuma podnošenja prijave,

e) podatke i priloge koji identificiraju topografiju: i) nacrti ili fotografije planova za proizvodnju

poluvodičkog proizvoda, ili ii) nacrti ili fotografije planova ili njihovih dijelova za

proizvodnju poluvodičkog proizvoda, ili iii) nacrti ili fotografije pojedinačnih slojeva

poluvodičkog proizvoda. (3) Materijalu iz stavka 2. točke e) ovoga članka

mogu se priložiti: nosači podataka, njihovi ispisi, poluvodički proizvod za čiju topografiju je registracija zahtijevana, ili potanak opis.

(4) Za svaku pojedinu topografiju podnosi se posebna prijava.

(5) Ministar nadležan za rad Zavoda, na prijedlog ravnatelja Zavoda, donosi pravilnik kojim se uređuje oblik prijave te način popunjavanja i podnošenja prijave.

Članak 8. (1) Podnositelj prijave topografije ima pravo pojedini

od potrebnih materijala ili bilo koji njegov dio označiti kao poslovnu tajnu, u kojem slučaju ti dijelovi neće biti dostupni javnosti.

(2) Sud može naložiti otkrivanje materijala iz stavka 1. ovoga članka i to samo osobama koje su uključene u spor koji se odnosi na valjanost ili povredu isključivih prava iz članka 14. ovoga Zakona.

ISPITIVANJE PRIJAVE TOPOGRAFIJE

Članak 9. (1) Zavod ispituje sadržava li prijava topografije sve

elemente iz članka 7. stavka 2. ovoga Zakona. (2) Ako prijava ne sadrži sve elemente iz članka 7.

stavka 2. ovoga Zakona, Zavod će pozvati podnositelja prijave da ukloni nedostatke u roku koji ne može biti kraći od jednog mjeseca niti duži od tri mjeseca.

(3) Ako podnositelj prijave ukloni sve nedostatke u roku iz stavka 2. ovoga članka, datum primitka uredne prijave smatra se datumom podnošenja prijave.

(4) Ako podnositelj prijave ne ukloni sve nedostatke u roku iz stavka 2. ovoga članka, Zavod odbacuje prijavu zaključkom.

REGISTRACIJA I OBJAVA REGISTRIRANE TOPOGRAFIJE

Članak 10. (1) Ako prijava sadrži sve elemente iz članka 7.

stavka 1. ovoga Zakona, Zavod izdaje podnositelju prijave rješenje o registraciji topografije.

(2) Topografija se upisuje u registar topografija i podaci iz registra objavljuju se u službenom glasilu Zavoda.

REGISTAR TOPOGRAFIJA

Članak 11. (1) Registar topografija vodi Zavod. (2) Registar iz stavka 1. ovoga članka je javan. (3) U registar topografija za svaku topografiju

upisuju se sljedeći podaci: a) registarski broj topografije, b) datum podnošenja prijave, c) datum i broj rješenja o upisu u registar, d) naziv topografije, e) podaci o podnositelju prijave: prezime i ime te

prebivalište, državljanstvo, ako je riječ o fizičkoj osobi, odnosno naziv i sjedište, ako je riječ o pravnoj osobi, pri čemu podaci za pravne osobe moraju biti suglasni s podacima iz sudskog registra,

f) podaci o stvaratelju: prezime i ime te naziv, pri čemu je dovoljan navod mjesta i države,

g) datum prvoga komercijalnog iskorištavanja topografije, ako je topografija već bila komercijalno iskorištavana,

h) podaci o zastupniku, ako postoji, i) podaci o promjenama koje se odnose na: prijenos

prava, licenciju, proglašavanje ništavim, prestanak vrijednosti i druge promjene koje su bitne za pravni status registrirane topografije.

(4) Ministar nadležan za rad Zavoda, na prijedlog ravnatelja Zavoda, donosi pravilnik kojim se propisuje obrazac registra i način vođenja registra topografija.

PLAĆANJE UPRAVNIH PRISTOJBI I NAKNADA TROŠKOVA POSTUPKA

Članak 12. (1) Za radnje poduzete u upravnom postupku za

registraciju topografije plaća se upravna pristojba i naknada troškova postupka u skladu s posebnim propisima.

(2) Ako propisana upravna pristojba i naknada troškova nije plaćena u propisanom roku, prijava se smatra povučenom.

PROGLAŠAVANJE NIŠTAVIM RJEŠENJA O REGISTRACIJI TOPOGRAFIJE

Članak 13. (1) Rješenje o registraciji topografije proglašava se

ništavim ako se utvrdi: a) da topografija ne udovoljava uvjetima iz članka

3. stavka 1. ovoga Zakona,

b) da je prijava podnesena od strane fizičke ili pravne osobe koja nema pravo na zaštitu,

c) da prijava nije podnesena u roku iz članka 19. ovoga Zakona,

d) da na temelju planova koji se odnose na registriranu topografiju nije moguća njena identifikacija.

(2) Postupak za proglašavanje ništavim rješenja o registraciji topografije može pokrenuti Zavod po službenoj dužnosti ili na prijedlog fizičke ili pravne osobe ili državnog odvjetnika zbog razloga iz stavka 1. ovoga članka, i to za cijelo vrijeme trajanja vrijednosti topografije.

IV. UČINCI ZAŠTITE I OGRANIČENJA

ISKLJUČIVA PRAVA

Članak 14. (1) Isključiva prava iz članka 3. ovoga Zakona

uključuju pravo davanja odobrenja ili zabranjivanja bilo koje od sljedećih radnji:

a) umnožavanje topografije, b) uvoz, prodaju ili druge načine stavljanja u promet

topografije ili poluvodičkog proizvoda proizvedenog korištenjem zaštićene topografije, kao i proizvoda u koji je ugrađen poluvodički proizvod koji sadrži zaštićenu topografiju.

(2) Isključiva prava iz stavka 1. ovoga članka ne odnose se ni na koji koncept, postupak, sustav, tehniku proizvodnje topografije ili informaciju sadržanu u topografiji, nego samo na topografiju kao takvu.

OGRANIČENJA ISKLJUČIVIH PRAVA

Članak 15. Bez odobrenja nositelja isključivih prava iz zaštićene

topografije, dopušteno je sljedeće: 1. umnožavanje zaštićene topografije za osobne

potrebe u nekomercijalne svrhe, 2. umnožavanje zaštićene topografije u svrhu

analiziranja, procjene ili učenja o konceptima, procesima, sustavima ili tehnikama sadržanima u topografiji, ili same topografije,

3. komercijalno iskorištavanje nove topografije stvorene na temelju proučavanja i analize zaštićene topografije koja je rezultat stvarateljevoga intelektualnog napora i koja nije uobičajena u industriji poluvodiča.

Članak 16. (1) Osoba koja prilikom stjecanja poluvodičkog

proizvoda nije znala ili nije imala razloga vjerovati da je riječ o proizvodu na kojemu postoje isključiva prava iz zaštićene topografije, ne može se spriječiti u komercijalnom iskorištavanju toga proizvoda.

(2) Za komercijalno iskorištavanje poluvodičkog proizvoda koje uslijedi nakon što je osoba iz stavka 1. ovoga članka saznala ili je imala opravdanog razloga vjerovati da se radi o proizvodu na kojemu postoje isključiva prava iz zaštićene topografije, odgovarajuću naknadu određuje sud, osim ako stranke ne riješe

spor putem pregovora, posredovanjem ili obvezujućom odlukom arbitraže.

(3) Odredbe iz stavka 1. i 2. ovoga članka odnose se i na pravne sljednike osobe koja je stekla poluvodički proizvod na kojemu postoje isključiva prava iz zaštićene topografije.

ISCRPLJENJE PRAVA

Članak 17. Iscrpljenje isključivih prava na davanje odobrenja ili

zabranjivanje radnji navedenih u članku 14. stavku 1. ovoga Zakona nastupa u trenutku stavljanja zaštićene topografije ili poluvodičkog proizvoda proizvedenog korištenjem zaštićene topografije na tržište Republike Hrvatske od strane nositelja isključivih prava iz zaštićene topografije ili uz njegovo odobrenje.

V. TRAJANJE ISKLJUČIVIH PRAVA

NASTANAK ISKLJUČIVIH PRAVA

Članak 18. Isključiva prava iz zaštićene topografije nastaju

nastupom ranijeg od sljedećih datuma: 1. datuma prvoga komercijalnog iskorištavanja

topografije bilo gdje u svijetu, ili 2. datuma podnošenja prijave za registraciju

topografije Zavodu.

PRESTANAK ISKLJUČIVIH PRAVA

Članak 19. (1) Isključiva prava prestaju vrijediti istekom roka od

10 godina računajući od nastupa ranijeg od sljedećih datuma:

a) kraja kalendarske godine u kojoj se topografija počela prvi put komercijalno iskorištavati bilo gdje u svijetu, ili

b) kraja kalendarske godine u kojoj je podnesena uredna prijava za registraciju topografije.

(2) Ako topografi ja ni je bi la komerci jalno iskorištavana bilo gdje u svijetu, isključiva prava istječu nakon isteka 15 godina od dana njezinoga prvog fiksiranja ili kodiranja, ako u tom roku ne bude podnesena uredna prijava za njezinu registraciju.

Članak 20. Prijava za registraciju topografije ne može se

podnijeti nakon isteka roka od dvije godine od datuma početka prvoga komercijalnog iskorištavanja topografije.

OZNAČAVANJE TOPOGRAFIJE

Članak 21. Za vrijeme trajanja isključivih prava, nositelj

registrirane topografije ima pravo poluvodički proizvod koji je proizveden korištenjem registrirane topografije, označavati velikim slovom »T«.

VI. GRAĐANSKOPRAVNA ZAŠTITA

Članak 22. (1) Nositelj isključivih prava iz zaštićene topografije

čija su prava povrijeđena može zahtijevati, uz naknadu štete, i poduzimanje mjera radi sprječavanja daljnjega povređivanja svojih isključivih prava.

(2) Osoba koja povređuje isključiva prava koja proizlaze iz zaštićene topografije odgovara za štetu prema općim načelima o naknadi štete.

(3) Odredba iz stavka 1. ovoga članka primjenjuje se i na pravne slijednike nositelja zaštićene topografije.

VII. PRIJELAZNE I ZAVRŠNE ODREDBE

Članak 23. Odredbe Zakona o patentima koje se odnose na

zastupanje, nositelje zajedničkog prava, postupak za proglašenje ništavim, rokove za podnošenje tužbe zbog povrede prava, prijenos prava, licencne ugovore, primjenjuju se na odgovarajući način na topografije poluvodičkih proizvoda koje su predmet uređivanja

ovoga Zakona.

Članak 24. Odredbe ovoga Zakona primjenjuju se samo na

topografije nastale nakon njegova stupanja na snagu.

Članak 25. Pravilnik kojim se uređuju pitanja iz članka 7. stavka

5. i članka 11. stavka 4. ovoga Zakona donijet će ministar nadležan za rad Zavoda, na prijedlog ravnatelja Zavoda, do početka primjene ovoga Zakona.

Članak 26. Danom početka primjene ovoga Zakona prestaje

važiti Zakon o zaštiti planova rasporeda integriranih sklopova (»Narodne novine«, br. 78/99. i 127/99.).

Članak 27. Ovaj Zakon stupa na snagu osmoga dana od dana

objave u »Narodnim novinama« a primjenjuje se od 1. siječnja 2004.

Članak 1. U Zakonu o zaštiti topografija poluvodičkih pro-

iz-voda (»Narodne novine«, br. 173/03.) u članku 4. iza stavka 4. dodaje se novi stavak 5. koji glasi:

»(5) Kada ne postoji pravo na zaštitu prema drugim odredbama ovoga članka, pravo na zaštitu topografije imaju i osobe iz stavka 4. točke a) i točke b) ovoga članka, ako su:

a) na teritoriju Republike Hrvatske prve gospodarski iskorištavale topografiju koja nije do tada bila predme- tom gospodarskog iskorištavanja igdje u svijetu, i

b) u Europskoj uniji bile isključivo ovlaštene na gospodarsko iskorištavanje topografije od strane osobe koja je imala pravo njome raspolagati.« U dosadašnjem stavku 5., koji postaje stavak 6., brojka: »4.« zamjenjuje se brojkom: »5.«.

Članak 2. Članak 6. mijenja se i glasi: »(1) Zavod provodi upravni postupak za registraciju

topografije, za proglašenje ništavim rješenja o registraciji topografije te obavlja druge upravne i stručne poslove u pogledu zaštite topografija poluvodičkih proizvoda.

(2) Protiv upravnih akata koje Zavod donosi u prvom stupnju dopuštena je žalba o kojoj odlučuje Žalbeno vijeće u skladu s odredbama ovoga Zakona.

(3) Za pojedina pitanja iz postupka iz stavka 1. i 2. ovoga članka koja nisu uređena ovim Zakonom, primje- njuju se odredbe Zakona o općem upravnom postupku.

(4) Protiv upravnih akata koje je u drugom stupnju donijelo Žalbeno vijeće može se voditi upravni spor u skladu sa Zakonom o upravnim sporovima.«

Članak 3. U članku 11. stavak 4. briše se.

Članak 4. U članku 12. stavku 1. dodaje se druga rečenica

koja glasi: »Ako propisana upravna pristojba i naknada troškova nije plaćena u propisanom roku, prijava se smatra povučenom.«

Stavak 2. mijenja se i glasi: »(2) Za podnošenje žalbe plaća se upravna pristojba

i naknada troškova u skladu s posebnim propisom. Ako propisana upravna pristojba i naknada troškova nije plaćena prije isteka roka za žalbu, smatra se da žalba nije podnesena.«

Članak 5. Članak 17. mijenja se i glasi: »Stavljanjem u promet od strane nositelja

iskl jučiv ih prava iz zašt ićene topograf i je i l i uz njegovu izr ič i tu suglasnost, na području Republike Hrvatske, odnosno nakon stupanja Republike Hrvatske u punopravno članstvo Europske

unijenapodručjunekeoddržavaEuropskeunijeodnosno država koje su stranke ugovornice Ugovora o Europskom ekonomskom prostoru, zaštićene topografije ili poluvodičkog proizvoda proizvedenog korištenjem zaštićene topografije, iscrpljuju se za područje Republike Hrvatske isključiva prava koja proizlaze iz zaštićene topografije.«

Članak 6. Članak 23. mijenja se i glasi: »OdredbeZakonaopatentukojeseodnosenazastupa-

nje, nositelje zajedničkog prava, postupak za progla-še- nje ništavim, podnošenje tužbe zbog povrede prava, zahtjev za utvrđenjem i zahtjev za prestankom povrede, zahtjev za naknadom štete, postupak povodom povrede prava, druga pitanja vezana uz građanskopravnu zaštitu prava, prijenos prava, ugovore o licenciji, žalbu, postupak povodom žalbe, žalbena vijeća te upravni spor, primje- njuju se na odgovarajući način na topografije poluvodičkih proizvoda koje su predmet uređivanja ovoga Zakona.«

PRIJELAZNE I ZAVRŠNE ODREDBE

Članak 7. Na postupke koji se na dan stupanja na snagu

ovoga Zakona vode zbog zaštite prava koja proizlaze iz registrirane topografije poluvodičkog proizvoda dovršit će se prema odredbama Zakona koji je bio na snazi do stupanja na snagu ovoga Zakona.

Članak 8. Pravilnik iz članka 25. Zakona o zaštiti topografija

poluvodičkih proizvoda (»Narodne novine«, br. 173/03.) uskladit će s odredbama ovoga Zakona ministar nad-le- žan za rad Zavoda, na prijedlog ravnatelja Zavoda, najkasnije u roku od 3 mjeseca od dana stupanja na snagu ovoga Zakona.

Članak 9. Ovaj Zakon stupa na snagu osmoga dana od dana

objave u »Narodnim novinama«, osim: – odredaba članka 1. ovoga Zakona koje stupaju na

snagu danom prijma Republike Hrvatske u punopravno članstvo Europske unije i

– odredaba članka 2. ovoga Zakona koje stupaju na snagu 1. lipnja 2008.

ZAKON O IZMJENAMA ZAKONA O ZAŠTITI TOPOGRAFIJA POLUVODIČKIH PROIZVODA**

Članak 1. U Zakonu o zaštiti topografija poluvodičkih proizvo-

da (»Narodne novine«, br. 173/03. i 76/07.) u članku 14. stavku 1. točki b) riječi: »uvoz, prodaju ili druge načine stavljanja u promet« zamjenjuju se riječima: »komerci- jalno iskorištavanje ili uvoz za te svrhe«.

Članak 2. Članak 17. mijenja se i glasi: »Isključiva prava na davanje odobrenja ili zabranu

radnji iz članka 14. stavka 1. točke b) ovoga Zakona iscrpljuju se za područje Republike Hrvatske nakon što je zaštićenu topografiju ili poluvodički proizvod koji je proizveden korištenjem zaštićene topografije stavila u promet na području Republike Hrvatske, odnosno

nakon pristupanja Republike Hrvatske Europskoj uniji na području neke od država Europske unije, odnosno država koje su stranke ugovornice Ugovora o Europ- skom ekonomskom prostoru, osoba koja je ovlaštena odobriti komercijalno iskorištavanje topografije ili netko drugi uz njezinu suglasnost.«

PRIJELAZNE I ZAVRŠNE ODREDBE

Članak 3. Ovaj Zakon stupa na snagu osmoga dana od dana

objave u »Narodnim novinama«.

Članak 1. U Zakonu o zaštiti topografija poluvodičkih

proizvoda (»Narodne novine«, br. 173/03. i 76/07.) u članku 6. stavku 2. riječi: »upravnih akata« zamjenjuju se riječju: »rješenja«.

Stavak 3. briše se. U dosadašnjem stavku 4., koji postaje stavak 3.,

ZAKON O IZMJENAMA ZAKONA O ZAŠTITI TOPOGRAFIJA POLUVODIČKIH PROIZVODA****

Članak 1. U Zakonu o zaštiti topografija poluvodičkih proizvoda

(»Narodne novine«, br. 173/03., 76/07., 30/09. i 49/11.) članak 6. mijenja se i glasi:

»(1) Državni zavod za intelektualno vlasništvo (u daljnjem tekstu: Zavod) provodi upravni postupak za registraciju topografije, za proglašenje ništavim rješenja o registraciji topografije te obavlja druge upravne i stručne poslove u pogledu zaštite topografija poluvodičkih proizvoda.

(2) Protiv rješenja Zavoda žalba nije dopuštena, ali se može pokrenuti upravni spor pred Upravnim sudom u Zagrebu.

(3) Postupak iz stavka 2. ovoga članka je hitan.«.

Članak 2. U članku 12. stavak 2. briše se.

Članak 3. U članku 23. iza riječi: »licenciji« brišu se zarez

i riječi: »žalbu, postupak povodom žalbe, žalbena vijeća«..

PRIJELAZNE I ZAVRŠNE ODREDBE

Članak 4. Ministar nadležan za nadzor nad radom Državnog

zavoda za intelektualno vlasništvo uskladit će Pravilnik o zaštiti topografija poluvodičkih proizvoda (»Narodne novine«, br. 72/04., 117/07. i 43/17.) s odredbama ovoga Zakona u roku od 30 dana od dana stupanja na snagu ovoga Zakona.

Članak 5. (1) Upravni postupci započeti po odredbama Zakona

o zaštiti topografija poluvodičkih proizvoda (»Narodne novine«, br. 173/03., 76/07., 30/09. i 49/11.) u kojima je Državni zavod za intelektualno vlasništvo kao tijelo prvog stupnja donio rješenje do dana stupanja na snagu ovoga Zakona, dovršit će se po odredbama toga Zakona i propisa donesenih na temelju toga Zakona.

(2) Žalbena vijeća u području prava industrijskog vlasništva osnovana i imenovana temeljem Zakona o patentu (»Narodne novine«, br. 173/03., 54/05., 87/05., 76/07., 30/09., 128/10., 49/11. i 76/13.) nastavljaju s radom sukladno odredbama toga Zakona i propisa donesenih na temelju toga Zakona dok svi upravni postupci iz stavka 1. ovoga članka ne budu pravomoćno riješeni, nakon čega prestaju s radom.

(3) U slučaju da zbog razrješenja predsjednika ili članova Žalbenih vijeća iz stavka 2. ovoga članka ne bude moguće odrediti Žalbeno vijeće koje odlučuje o žalbi, iznimno se može provesti postupak izbora i imenovanja predsjednika ili potrebnog broja članova Žalbenih vijeća sukladno odredbama Zakona o patentu (»Narodne novine«, br. 173/03., 54/05., 87/05., 76/07., 30/09., 128/10., 49/11. i 76/13.), za potrebe rješavanja predmeta iz stavka 1. ovoga članka.

Članak 6. Ovaj Zakon stupa na snagu osmoga dana od dana

objave u »Narodnim novinama«.
