Presidente Constitucional de la República del Ecuador

Considerando:

Que la Ley de Derecho de Autor permite facultativamente el registro en la Dirección Nacional de Derechos de Autor de las distintas obras protegidas por dicha ley;

Que es necesario facilitar el cumplimiento de dicha disposición con respecto a determinadas obras protegidas por dicha ley y las Convenciones Internacionales sobre Derechos de Autor vigentes en el Ecuador;

En ejercicio de las atribuciones que le confieren la Constitución y la Ley,

Decreta:

1. En el Registro Nacional de los Derechos de Autor se inscribirán, con la sola presentación de la solicitud pertinente, las obras que se encuentren protegidas por los Convenios Internacionales y la Ley de Derechos de Autor, inclusive aquellas sujetas a fijación electromagnética u otras, como por ejemplo los programas de ordenadores (software) y las señales codificadas de satélite y, en general cualquier otro derecho de autor.

El registro no es requisito indispensable para el ejercicio de las acciones judiciales y para la defensa de los derechos, de acuerdo con la Ley y los Convenios Internacionales.

2. De la ejecución del presente Decreto que entrará en vigencia a partir de su publicación en el Registro Oficial, encárgase al Ministro de Educación y Cultura.
