Details Details Year of Version 1994 Dates Adopted: May 18, 1994 Type of Text IP-related Laws Subject Matter Copyright and Related Rights (Neighboring Rights) Notes Date on which Estonia became party to the Convention (Paris Act): October, 26 1994.

The notification by Estonia to the WTO under article 63.2 of TRIPS states:
'1. The Republic of Estonia, in accordance with Article 1.3 of the Agreement on Trade-Related Aspects of Intellectual Property Rights, will not apply the criterion of publication referred to in Article 5(1)(c) of the Rome Convention as regards the protection of producers of phonograms.
2. In accordance with Article 1.3 of the Agreement on Trade-Related Aspects of Intellectual Property Rights, the Republic of Estonia avails itself of the possibility provided in Article 6(2) of the Rome Convention and, consequently, will protect broadcasts only if the headquarter of the broadcasting organization is situated in a WTO Member and the broadcast was transmitted from a transmitter situated in the same WTO Member.'

Berni kirjandus- ja kunstiteoste kaitse konventsiooniga ühinemise seadus

Vastu võetud 18.05.1994 (õ) 25.12.2008

§ 1. Taasühinemiseks Berni kirjandus- ja kunstiteoste kaitse 1886. aasta konventsiooniga, mille revideeritud tekstiga ühines Eesti Vabariik 1927. aasta 31. märtsi seaduse (RT 1927, 44, 41) alusel, ühineda juurdelisatud Berni kirjandus- ja kunstiteoste kaitse konventsiooni Pariisi 1971. aasta 24. juuli redaktsiooniga (muudatustega 1979. aasta 28. septembrist).

§ 2. Deklareerida, et Berni konventsiooniga kaitstud teost, mis on käesoleva seaduse jõustumise päevaks juba tõlgitud eesti keelde, kuid ei ole veel avaldatud, võib 18 kuu jooksul käesoleva seaduse jõustumisest arvates avaldada või muul viisil sihipäraselt kasutada (lavastada, avalikult esitada, üle kanda raadios või televisioonis) autorile tasu maksmata.

§ 3. Deklareerida, et vastavalt käesoleva seaduse §-s 1 nimetatud konventsiooni artiklile

25(4)(a) ja (b) soovib Eesti Vabariik kuuluda oma liikmemaksu suuruse arvestuselt VII klassi.
