Details Details Year of Version 1996 Dates Entry into force: January 1, 1996 Adopted: December 22, 1995 Type of Text Other Texts Subject Matter Enforcement of IP and Related Laws Notes The notification by Finland to the WTO under Article 63.2 of TRIPS states:
'The amendment extends the competence of the Customs Authority. In the case of evidently counterfeit or pirated goods, the Customs Authority may notify the holder of the intellectual property right of a possible infringement irrespective of the lodging or approval of an application by the right holder'.

Laki

tullilain 25§:n muuttamisesta

Eduskunnan päätöksen mukaisesti

lisätään 29 päivänä joulukuuta 1994 annetun tullilain (1466/94) 25  §:ään uusi 3 momentti, jolloin nykyinen 3 momentti siirtyy 4 momentiksi, seuraavasti:

25§

Tullihallitus ja piiritullikamari saavat antaatietoja väärennettyjen ja laittomasti valmistettujen

tavaroiden vapaaseen liikkeeseen luovutuksen, viennin, jälleenviennin tai

suspensiomenettelyyn asettamisen kieltävistä toimenpiteistä annetussa neuvoston asetuksessa

((EY) N:o 3295/94) tarkoitetulle oikeudenhaltijalle tulliviranomaisen havaitsemista

asetuksessa tarkoitetuista todennäköisesti väärennetyistä tai laittomasti valmistetuista

tavaroista.

Tämä laki tulee voimaan 1 päivänä tammikuuta 1996.
