I assent,

 

AN ACT

 

TO AMEND THE CONSUMER PROTECTION ACT

 

BE IT ENACTED by the King and Legislative Assembly of Tonga in the Legislature of the Kingdom as follows:

 

1.

 

(1) This Act may be cited as the Consumer Protection (Amendment) Act 2009.

 

(2) The Consumer Protection Act 2000 shall be referred to in this Act, as the Principal Act.

 

2. Section 2 of the Principal Act is amended by inserting the following definitions in the appropriate places:

 

National Biosafety Advisory Committee means the National Biosafety Advisory Committee established under section 5 of the Biosafety Act; and

 

living modified organism has the same meaning as under the Biosafety Act;.

 

3. Section 12(2) of the Principal Act is amended by inserting the following proviso:

 

Provided that if a good is or contains a living modified organism the approved standards applied to it shall comply with any standards or conditions set by the National Biosafety Advisory Committee.

 

Passed in the Legislative Assembly this 29 day of October 2009.
