Act No. 575 of June 26, 1992 on the Organization of the National Board of Patents and Registration* (as amended on December 13, 1994)

The Position of the Office

1. The National Board of Patents and Registration functions under the Ministry of Trade and Industry.

Duties

2. The mission of the National Board of Patents and Registration is to further technical and economic progress. The Board shall deal with matters relating to patents, topographies of integrated circuits, utility model rights, design rights, trademarks, enterprise mortgages, the Trade Register, the Register of Associations, the Foundation Register and the supervision of foundations referred to in the Foundations Act (109/30), trade names and the making available to the public of annual accounts documents; it shall provide information services in the field. Government may by decree also order other matters connected with industrial property rights and the maintenance of registers to be dealt with by the Board. (13.12.1994/1173)

The National Board of Patents and Registration shall carry out any investigations, experiments and monitoring and planning tasks assigned to it by the Ministry of Trade and Industry.

Board of Directors

3. The National Board of Patents and Registration shall have a Board of Directors, the members of which shall be appointed by the Council of State. The tasks, composition and term of office of the Board of Directors shall be laid down by decree.

Taking Decisions

4. Matters pending with the National Board of Patents and Registration shall be decided on by the Board of Directors, the Director General, or other official of the National Board of Patents and Registration, as laid down by decree.

Appealing

5. Any decision by the National Board of Appeal may be appealed to the Board of Appeal of the National Board of Patents and Registration, as laid down by a special Act.

A decision by the National Board of Appeal on a matter not falling under the jurisdiction of the Board of Appeal of the National Board of Patents and Registration may be appealed against, unless otherwise prescribed, to the Supreme Administrative Court, as laid down by a special Act.

Fees

6. Special provisions shall be given in respect of fees collected by the National Board of Patents and Registration and of stamp duties payable on documents.

More Specific Provisions

7. More specific provisions on the implementation of this Act shall be decreed by the Government.

Entry into Force

8. This Act shall enter into force on September 1, 1992.

This Act repeals the Act on the National Board of Patents and Registration issued on December 30, 1965 (749/65), with subsequent amendments.

Any action necessary for the implementation of this Act may be taken before the entry into force of this Act.

. L’Office national des brevets et de l’enregistrement relève du Ministère du commerce et de l’industrie.

Attributions

2. L’Office national des brevets et de l’enregistrement est chargé de promouvoir le progrès technique et économique. Il traite des questions liées aux brevets d’invention, aux topographies de circuits intégrés, aux droits sur les modèles d’utilité, aux droits de dessin ou modèle, aux marques, aux hypothèques grevant les entreprises, au registre du commerce, au registre des associations, au registre des fondations et à la surveillance des fondations visées dans la loi relative aux fondations (109/30), aux noms commerciaux et à la mise à disposition du public des documents comptables annuels; il fournit des services d’information y relatifs. Le gouvernement peut également ordonner par voie de décret que l’office traite d’autres questions relatives aux droits de propriété intellectuelle et à la tenue de registres. (13.12.1994/1173)

L’Office national des brevets et de l’enregistrement mène toutes recherches, expériences et tâches de suivi et de planification qui lui sont assignées par le Ministère du commerce et de l’industrie.

Conseil d’administration

3. L’Office national des brevets et de l’enregistrement est doté d’un Conseild’administration, dont les membres sont désignés par le Conseil d’État. Les attributions, la composition et la durée du mandat du Conseil d’administration sont fixées par voie de décret.

Décisions

4. Les questions en suspens auprès de l’Office national des brevets et de l’enregistrement sont tranchées par le Conseil d’administration, le directeur général ou un autre fonctionnaire dudit office, conformément aux dispositions édictées par décret.

Recours

5. Les décisions rendues par la Chambre nationale des recours peuvent être portées devant la Commission des recours de l’Office national des brevets et de l’enregistrement, conformément aux dispositions édictées dans la loi correspondante.

Sauf dispositions contraires, un recours peut être formé devant le Tribunal administratif suprême contre une décision de la Chambre nationale des recours en ce qui concerne une question ne relevant pas de la compétence de la Commission des recours de l’Office national des brevets et de l’enregistrement, conformément aux dispositions édictées dans la loi correspondante.

Taxes

6. Les taxes perçues par l’Office national des brevets et de l’enregistrement et les droits de timbre dus sur les documents font l’objet de dispositions particulières.

Dispositions expresses complémentaires

7. Des dispositions expresses complémentaires relatives à l’application de la présente loi sont édictées par décret du gouvernement.

Entrée en vigueur

8. La présente loi entrera en vigueur le 1 er

septembre 1992.

La présente loi abroge la loi n° 749/65 du 30 décembre 1965 relative à l’Office national des brevets et de l’enregistrement, telle qu’elle a été modifiée ultérieurement.

Toute mesure nécessaire à l’exécution de la présente loi peut être prise avant l’entrée en vigueur de celle-ci.
