PATENTS (AMENDMENT) REGULATIONS 1990

IN exercise of the powers conferred by section 87 of the Patents Act 1983 [Act 291], the Minister makes the following regulations:

Citation and commencement

These Regulations may be cited as the Patents (Amendment) Regulations 1990 and shall be deemed to have come into force on the 1st October 1986.

Amendment of regulation 13

Sub‐regulation (1) of regulation 13 of the Patents Regulations 1986 [P.U. (A) 327/86], hereinafter referred to as the "principal Regulations", is amended by substituting therefor the following:

"(1) The claims shall be clear and concise and fully supported by the description; and the number of the claims shall be reasonable taking into consideration the nature of the invention.".

Amendment of regulation 15

In the English text sub‐regulation (2) of regulation 15 of the principal Regulations is amended by substituting for the word "field" the word "filed".

Amendment of regulation 17

In the English text sub‐regulation (2) of regulation 17 of the principal Regulations is amended by substituting for the word "tempretures" by the word "Temperatures".

Amendment of regulation 20

Regulation 20 of the principal Regulations is amended by inserting immediately after the word "disclosure" the words "which he is aware of and".

Amendment of regulation 24

Sub‐regulation (1) of regulation 24 of the principal Regulations is amended by substituting for the word "in" the word "on".

Amendment of regulation 35

Sub regulations (1) and (2) of regulation 35 of the principal Regulations are amended by substituting for the word "in" the word "on".

Amendment of regulation 49

Paragraph (b) of sub‐regulation (2) of regulation 49 of the principal Regulations is amended by inserting immediately after the words "High Court" the words:

"in Malaya, or an advocate of the High Court in Borneo".

Amendment of regulation 51

Regulation 51 of the principal Regulations is amended by inserting immediately after sub‐ regulation (2) the following new sub‐regulation (3):

"(3) The furnishing of Form 20 is not required if the address for service has already been furnished in any other Form in Schedule II to these Regulations, and that address for service has not changed in any way.".

Amendment of Schedule II

Patents FormNo. 1 in Schedule II to the principal Regulations is amended by substituting for the words "Please submit this Form in duplicate." the words "Please submit this Form in duplicate together with the prescribed fee.".
