The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred upon Her by section 13(1) and section 37(5) of the Registered Designs Act 1949 1, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows-

1. This Order may be cited as the Designs (Convention Countries) (Amendment) Order 1995 and shall come into force as follows:
(a) articles 1, 2(a) and 3(a)(i) and (b) shall come into force on 15th December 1995,
(b) articles 2(b) and 3(a)(ii) shall come into force on 25th December 1995; and
(c) articles 2(c) and 3(a)(iii) shall come into force on 1st January 1996.
2. The countries specified in:
(a) Part 1,
(b) Part 2, and
(c) Part 3,
of the Schedule to this Order are convention countries for the purposes of all the provisions of the Registered Designs Act 1949.
3. The Designs (Convention Countries) Order 19942 shall be amended by the insertion in Schedule 1 thereto:
(a) in proper alphabetical order of the countries specified in:
(i) Part 1,
(ii) Part 2, and
(iii) Part 3,

of the Schedule to this Order, and

(b) of "Korea, Democratic People's Republic of" in substitution for the words "Korea, Democratic Republic of".

EXPLANATORY NOTE

(This note is not part of the Order)

This Order, made pursuant to section 13(1) of the Registered Designs Act 1949, declares the countries specified in the Schedule to be convention countries for the purposes of all provisions of that Act. The countries specified in Part 1 and Part 2 of the Schedule to this Order have acceded to the International Convention for the Protection of Industrial Property ("the Paris Convention") (as revised at Stockholm in 1967) (Cmnd. 4431) since the last order (S.I. 1994/3219) was made. The countries specified in Part 3 of the Schedule to this Order are countries not party to the Paris Convention but are countries each of which is party to the Agreement Establishing the World Trade Organisation (including the Agreement on Trade-Related Aspects of Intellectual Property Rights) (Cm. 2556-59, 2561-69, 2571-74). They are designated as convention countries (and the appropriate amendments are made to the 1994 Order) from the date on which that part of the Agreement relating to intellectual property, including matters relating to designs, enters into force for the United Kingdom.
