《2017年專利條例 (修訂附表 1)令》
(由行政長官會同行政會議根據《專利條例》(第 514章 )第 153條作出 )
1. 生效日期 本命令自 2017年 4月 1日起實施。
2. 修訂《專利條例》 《專利條例》(第 514章 )現予修訂，修訂方式列於第 3條。
3. 修訂附表 1 (巴黎公約國及世界貿易組織成員國、地區及地方 ) 附表 1，在 “世界貿易組織成員國、地區及地方 (但不包括巴 黎公約國 )”標題下的列表，在“馬爾代夫共和國”項目之前——
加入 “阿富汗伊斯蘭共和國”。

Patents Ordinance (Amendment of Schedule 1) Order 2017
(Made by the Chief Executive in Council under section 153 of the Patents Ordinance (Cap. 514))
1. Commencement
This Order comes into operation on 1 April 2017.
2. Patents Ordinance amended
The Patents Ordinance (Cap. 514) is amended as set out in section 3.
3. Schedule 1 amended (Paris Convention countries and WTO member countries, territories and areas)
Schedule 1, list under heading “WTO member countries, territories and areas (not including Paris Convention countries)”, before item “The Republic of Cabo Verde”—
Add
“The Islamic Republic of Afghanistan”.

Explanatory Note Paragraph 1
Explanatory Note
As a member of the World Trade Organization (WTO), Hong Kong is obliged to grant to a person who has filed an application for a patent in a WTO member country, territory or area a right of priority during a prescribed period for the purpose of filing a corresponding application in Hong Kong.
2. Afghanistan has acceded to the World Trade Organization Agreement. This Order updates the list of WTO member countries, territories and areas (not including Paris Convention countries) contained in the Patents Ordinance (Cap. 514) to include it.
註釋
如任何人已在世界貿易組織成員國、地區或地方，提交專利 的申請，而該人在香港提交相應的申請，則香港作為世界貿 易組織成員，須讓該人在訂明期間，就有關的申請享有優先 權利。
2. 阿富汗已加入《世界貿易組織協議》。本命令更新《專利條例》 (第 514章 )所載的世界貿易組織成員國、地區及地方 (但不 包括巴黎公約國 )列表，以納入該國。
