Kundmachung des Bundeskanzlers vom 2. April 1973 über die Aufhebung des § 163
Patentgesetz 1970 durch den Verfassungsgerichtshof

Gemäß Art. 140 Abs. 3 des Bundes-Verfassungsgesetzes in der Fassung von 1929 und gemäß den §§ 64 und 65 des Verfassungsgerichtshofgesetzes 1953, BGBl. Nr. 85, wird kundgemacht:

(1)
Der Verfassungsgerichtshof hat mit seinem dem Bundeskanzleramt am 28. März 1973 zugestellten Erkenntnis vom 15. März 1973, G 46/72-11, den § 163 Patentgesetz 1970 (Anlage zur Kundmachung der Bundesregierung vom 7. Juli 1970, BGBl. Nr. 259, mit der das Patentgesetz 1950 wiederverlautbart wird) als verfassungswidrig aufgehoben.
(2)
Die Aufhebung tritt mit Ablauf des 28. Feber 1974 in Kraft.
(3)
Frühere gesetzliche Bestimmungen treten nicht wieder in Kraft. Kreisky
