Kundmachung des Bundeskanzlers vom 8. November 1973 über die Aufhebung einiger Worte im § 146 Abs. 2 des Patentgesetzes 1970 durch den Verfassungsgerichtshof

Gemäß Art. 140 Abs. 3 des Bundes-Verfassungsgesetzes in der Fassung von 1929 und gemäß den §§ 64 und 65 des Verfassungsgerichtshofgesetzes 1953, BGBl. Nr. 85, wird kundgemacht:

(1)
Der Verfassungsgerichtshof hat mit Erkenntnis vom 17. Oktober 1973, G 18, 19/73, — dem Bundeskanzleramt zugestellt am 6. November 1973 — die im § 146 Abs. 2 des Patentgesetzes 1970, BGBl. Nr. 259, enthaltenen Worte „auch wenn er von Dritten gestellt wird" als verfassungswidrig aufgehoben.
(2)
Frühere gesetzliche Bestimmungen treten nicht wieder in Kraft.
