TRADE MARKS

The Community Trade Mark (Amendment) Regulations 2004

Made - - - - 28th March 2004

Laid before Parliament 31st March 2004

Coming into force in accordance with regulation 1(2).

The Secretary of State in exercise of the powers conferred upon her by section 52 of the Trade Marks Act 1994(1) hereby makes the following Regulations:

1.—(1) These Regulations may be cited as the Community Trade Mark (Amendment) Regulations 2004.

(2) These Regulations shall come into force on 5th May 2004 immediately after the Trade Marks (Amendment) Rules 2004(2).

2. The Community Trade Mark Regulations 1996(3) shall be amended as follows.

3. In regulation 2 for the words “Trade Marks Rules 1994” there shall be substituted “Trade Marks Rules 2000”(4).

4. In the title of regulation 11 for the words “Trade Marks Rules 1994” there shall be substituted “Trade Marks Rules 2000”.

5. In regulation 3(4) for the words “rule 31” there shall be substituted “rules 31 to 37”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Community Trade Mark Regulations 1996 (SI 1996/1908) (“the 1996 Regulations”). Regulations 3 and 4 amend regulations 2 and 11 of the 1996 Regulations. The amendments substitute references to the Trade Mark Rules 1994 (now revoked) with references to the Trade Mark Rules 2000 (SI 2000/136 as amended by SI 2001/3832 and SI 2004/947). Regulation 5 amends regulation 3 of the 1996 Regulations. This amendment updates the 1996 Regulations in line with the regime under the Trade Marks Rules 2000. A Regulatory Impact Assessment is available, copies of which have been placed in the libraries of both Houses of Parliament. Copies of the assessment are also available from the Trade Marks Directorate, The Patent Office, Concept Office, Cardiff Road, Newport, NP10 8QQ.
