The Minister makes the following Regulations pursuant to section 39 of the Food Safety Act 2005:

1 Citation

These Regulations may be cited as the Food (Prohibited Imports) Regulations 2016.

2 Commencement

These Regulations commence on the day in which they are published in the Gazette.

3 Interpretation

In these Regulations, unless the contrary intention appears, words and expressions defined in the Act have the same meaning in these Regulations.

4 Prohibited imports

(1)A person must not import into Nauru directly from the People’s Republic of China and Hong Kong, any food or food products produced in the People’s Republic of China and Hong Kong.

(2)Despite sub-regulation (1), food or food products produced in the People’s Republic of China and Hong Kong, may be imported into Nauru from Australia and New Zealand.

(3)A person who breaches sub-regulation (1), is guilty of an offence.
