Details Details Year of Version 2023 Dates Amended up to: June 29, 2023 Entry into force: January 1, 2008 Signature: December 18, 2006 Type of Text Main IP Laws Subject Matter Patents (Inventions), Utility Models, Industrial Designs, Trademarks, Geographical Indications, Trade Names, Layout Designs of Integrated Circuits, Competition, Undisclosed Information (Trade Secrets), Plant Variety Protection, Copyright and Related Rights (Neighboring Rights), Enforcement of IP and Related Laws, Transfer of Technology, IP Regulatory Body, Industrial Property Notes This consolidated version of Civil Code of the Russian Federation (Part Four) takes into account amendments up to June 29, 2023 (date of entry into force of "Federal Law No. 193-FZ of June 28, 2022, on Amendments to Part Four of the Civil Code of the Russian Federation"). The said amending Federal Law No. 193-FZ of June 28, 2022, which entered into force one year after its date of publication introduced amendments (came into effect on June 29, 2023) to the following provisions under Chapter 70 "Copyright" and Chapter 76 "The Rights to The Means of Individualization of Legal Entities, Goods, Works, Services, and Enterprises" of this consolidated version of the Civil Code: 1) in paragraph 5 of Article 1262, the words “subject to without a contract” are replaced with the words “subject to without a contract and a pledge of the exclusive right to a registered computer program or database”; 2) in Article 1477 : a) in paragraph 1, delete the words “legal entities or individual entrepreneurs”; b) in paragraph 2 the words “legal entities or individual entrepreneurs” and the word “by them” should be deleted; 3) Article 1478 is declared invalid (repealed); 4) in paragraph 1 of Article 1492 , replace the words “individual entrepreneur” with the word “citizen”; 5) in paragraph 2 of Article 1512 : a) subparagraph 3 is declared invalid; b) in paragraph nine, replace the numbers “1 - 3” with the words “1 and 2”; 6) in paragraph 2 of Article 1513, replace the numbers “1 - 4” with the numbers “1, 2, 4”; 7) in subparagraph 4 of paragraph 1 of Article 1514, the words “registration of termination by a citizen of activity as an individual entrepreneur-right holder” were replaced with the words “with the death of the citizen-right holder, if there are no grounds for universal succession (inheritance, reorganization of a legal entity).”. The above-mentioned amendments introduced by the amending Federal Law No. 193-FZ of June 28, 2022 to the Civil Code allow individuals, not being individual entrepreneurs, to apply for national trademarks in Russia.
