Governor’s Decision No.306/95/M of December 4, 1995

(Fixing fees due for acts foreseen in the trademark protection legislation and the time and manner of settlement)

The Decree-Law No.56/95/M of November 6, 1995 that provides the legal framework for trademark protection in Macau stipulates in its Article 19 that the fees due for acts foreseen therein, as well as the time and manner of settlement thereof, shall be fixed by Governor’s Decision.

In view of the preceding,

After conferring with the Consultative Council,

In accordance with the provisions of Article 19 of Decree-Law No.56/95/M of November 6, 1995 and pursuant to the terms of Article 16 Paragraph 1 section c) of the Macau Organic Law, the Governor determines the following:

Article 1—1. The fees due for the acts foreseen in Decree-Law No.56/95/M of November 6, 1995 are those listed in the schedule attached to the present Decision, of which the latter is an integral part.

2. The fees listed in the above-mentioned schedule are inclusive of costs due for publishing applications in the Government’s Gazette.

Article 2—The moneys due shall be settled in cash or by cheque upon submission of the applications for the carrying out of the scheduled acts.

Article 3—Fees due in respect of registrations shall be settled:

a) Together with those due for issue of the relevant title after the date on which such title was granted and up to the maximum period of six months from the date of publishing of that grant in the Government’s Gazette;

b) in the last six months of the title’s validity, where fees due for registration renewal is concerned.

Article 4 1. The fees referred in section b) of Article 3 above may also be settled with a surcharge within a maximum period of six months starting from the last day of validity of a registration. Failure to comply with settlement requirements shall entail extinction of the relevant mark.

Renewal of a registration extinct for lack of payment of relevant fees due may be applied for within one year from the date of publishing of the extinction notice.

2.

Without prejudice of any third party’s rights, the renewal referred in para 2 above may be authorised upon payment of an amount corresponding to three times the fees in default.

Article 5—1. The fees mentioned in the provisions above shall not be refunded to the concerned parties.

2. Notwithstanding, any dues acknowledged as having been unduly paid may be refunded to the interested party, at his request, and upon authorisation in writing by the director of the Macau Economic Services.

3. Any fees deposited for settlement of costs in respect of unauthorised searches, or of searches that were abandoned in due time, shall be refunded at the request of the party who made such deposit.

Article 6—1. For the duration of a legal action taken over any claim on a mark, or while the lien or mortgage on it is not lifted, there shall be no notice of extinction of the relevant registration for lack of payment of any fees due from time to time.

The interested party shall apply to the competent court to undertake the official notification of a legal action pending to the Macau Economic Services. As soon as sentence is passed or the lien or mortgage becomes in any other manner extinct, the judicial authorities shall so notify the Macau Economic Services, either unofficially or at the request of the concerned party.

2.

Upon passing of a sentence over any of the circumstances described in para 2 above, the relevant notice thereof shall be published in the Government’s Gazette.

3.

Upon publication of the notice mentioned in para 3 , all fees in default shall be settled without surcharges within one year from the date of publication thereof.

4.

Should the one year period above elapse without settlement of all the fees due, the registration shall be declared extinct.

Article 7—The Present Decision is enforceable on the same date as Decree-Law No.56/95/M of November 6, 1995.

Portaria n.º 306/95/M

de 4 de Dezembro

O Decreto-Lei n.º 56/95/M, de 6 de Novembro, que regula a protecção de marcas em Macau, estipula no artigo 19.º que as taxas devidas pelos actos previstos naquele diploma, bem como o momento e o modo da sua cobrança, são fixados por portaria do Governador.

Nestes termos:

Ouvido o Conselho Consultivo:

Ao abrigo do disposto no artigo 19.º do Decreto-Lei n.º 56/95/M, de 6 de Novembro, e nos termos da alínea c) do n.º 1 do artigo 16.º do Estatuto Orgânico de Macau, o Governador determina:

Artigo 1.º— 1. As taxas devidas pelos actos previstos no Decreto-Lei n.º 56/95/M, de 6 de Novembro, são as constantes da tabela anexa à presente portaria e da qual é parte integrante.

2. As taxas constantes da tabela referida no número anterior incluem os custos de publicação dos pedidos no Boletim Oficial.

Artigo 2.º As importâncias devidas são pagas em numerário ou cheque, com os requerimentos em que se solicitem os actos tabelados.

Artigo 3.º As taxas relativas a registos são pagas:

a) Juntamente com as do respectivo título, após a data da concessão e até ao prazo máximo de seis meses a contar da data de publicação dessa concessão no Boletim Oficial;

b) Nos últimos seis meses da respectiva validade, no que respeita às taxas relativas à renovação dos registos.

Artigo 4.º— 1. As taxas a que se refere a alínea b) do artigo anterior podem ainda ser pagas com sobretaxa, durante o prazo máximo de seis meses a contar do termo da validade do registo, sob pena de extinção da marca.

2. Pode ser requerida a renovação de qualquer registo extinto por falta de pagamento de taxas, durante o prazo de um ano a contar da data de publicação do aviso de extinção.

3. A renovação a que se refere o número anterior pode ser autorizada com o pagamento do triplo das taxas em dívida e sem prejuízo de direitos de terceiros.

Artigo 5.º— 1. As taxas a que se referem as disposições anteriores não são restituídas às partes.

2. Mediante despacho do director da Direcção dos Serviços de Economia, podem todavia ser restituídas, a requerimento do interessado, as que se reconhecer terem sido pagas indevidamente.

3. As quantias depositadas para custeio de despesas de vistorias não autorizadas, ou de que se desistiu oportunamente, são restituídas a requerimento de quem as depositou.

Artigo 6.º— 1. Enquanto pender acção em juízo sobre algum direito à marca ou não for levantado o arresto ou a penhora que sobre o mesmo recair, não se declara a extinção do respectivo registo por falta de pagamento de taxas periódicas que se forem vencendo.

2. A parte interessada deve requerer em juízo que se faça a comunicação oficial da pendência da acção, arresto ou penhora à Direcção dos Serviços de Economia e, logo que a sentença transite em julgado ou por qualquer modo se extinga o arresto ou a penhora, deve o juiz comunicar tal facto à Direcção dos Serviços de Economia, oficiosamente ou a requerimento da parte.

3. Transitada em julgado qualquer das decisões referidas no n.º 2, do facto publica-se aviso no Boletim Oficial.

4. Publicado o aviso a que se refere o número anterior, todas as taxas em dívida devem ser pagas, sem qualquer sobretaxa, no prazo de um ano contado da sua data de publicação.

5. Decorrido o prazo previsto no número anterior sem que tenham sido pagas todas as taxas em dívida, o registo é declarado extinto.

Artigo 7.º A presente portaria entra em vigor na data da entrada em vigor do Decreto-Lei n.º 56/95/M, de 6 de Novembro.

十二月四日

在規範於澳門保護商標之十一月六日第56/95/M號法令第十九 條規定,作出該法規規定行為應付之費用以及徵收費用之時間及方式,由總督透過訓令訂立。

基於此;

經聽取諮詢會意見後;

總督根據十一月六日第 56/95/M號法令第十九條之規定及《澳門組織章程》第十六條第 一款c項之規定,命令:

第一條

一、作出十一月六日第56/95/M號法令所規定之行為應付之費用為附於本訓令之表中所載者,該表為本訓令之組成部分。

二、上款所指之表所戴之費用包括將有關請求公布於(政府公報)之費用。

第二條 應付之款項得以現金或支票支付,且應於要求作出表中所列行為時支付。

第三條 有關註冊之費用應:

a)與有關註冊證之費用一併繳交,但須從給予註冊之日起直至由該註冊於(政府公報)公布日起之最多六個月內繳交;

b)如屬繳交註冊續展費用,則於有效期之最後六個月內繳交。

第四條 一、上條b項所指之費用方可於由註冊有效期終止起計最多六個月之期限內與額外費用一併繳交,否則商標消滅。

二、從消滅之通告公布起計一年之期限內,得申請續展任何由於不支付費用而引致消滅之註冊。

三、許可上款所指之續展,得透過繳交所欠費用之三倍為之,但不得影響第三者之權利。

第五條 一、以上規定所指之費用不歸還予當事人。

二、應利害關係人之申請,經濟司司長得以批示將被確認為不當支付之款項歸還。

三、存放作為支付查驗開支之款項或在適當情況下放棄查驗者,得應存放者之申請歸還,但僅以申請查驗不獲許可為限。

第六條 一、當對某些商標權之訴訟仍待決或未終止對該商標權所進行之假扣押或查封之期間,不支付到期之定期費用時,不會宣告有關註冊消滅。

二、利害當事人得向法庭申請對經濟司發出有關訴之待決及假扣押或查封之官方通告;在判決確定或假扣押或查封以任何原因消滅時,法官須依職權或應 當事人之申

請,將該事實知會經濟司。

三、任何第二款所指之裁判在轉為確定時,應以通告之形式將該事實公布於(政府公報)

四、所有應付之費用在公布上款所指之通告後,從通告公布日起之一年期間內予以支付,而無需支付額外費用。

五、不在上款所指之期間內支付所有應付之費用,則

導致宣告註冊消滅。

第七條 本訓令於十一月六日第56/95/M號法令生效之 日起開始生效。
