REFORM OF THE LAW ON PLANT AND ANIMAL HEALTH

Legislative Decree No. 917, of December 15, 2005

THE LEGISLATIVE ASSEMBLY OF THE REPUBLIC OF EL SALVADOR,

WHEREAS:

I. By means of Legislative Decree No. 524, dated November 30, 1995, published in the Official Journal (Diario Oficial) No. 329, of December 18 of the same year, the Law on Plant and Animal Health was issued;

II . The aforementioned law establishes a series of measures and requirements for the import and export of plant, animal and other products, especially for the protection of consumer health, as well as the protection of the country's health heritage;

III. Modern processes of producing and trading in products and by-products of animal and plant origin require the State to modernize its plant and animal health organizational structure, so as to meet the requirements of international trade in agricultural products;

Given that the law referred to did not grant the Ministry of Agriculture and Livestock the power to recognize the inspection systems of third countries with which EI Salvador trades in plant and animal products, it is necessary to reform it in this regard, harmonizing its other provisions, to bring it into line with changes with regard to trade in by-products of animal and plant origin;

V. In addition, the Free Trade Agreement between Central America, the United States of America and the Dominican Republic, ratified by means of Legislative Decree No. 555, dated December 17, 2004, published in the Official Journal (Diario Oficial) No. 17, Volume No. 366, of January 25, 2005, contains provisions amending the Law referred to in the first paragraph; hence the need to amend the Law on Plant and Animal Health with a view to aligning national legislation with the provisions established in the Agreement.

THEREFORE,

By virtue of its constitutional powers and at the initiative of the President of the Republic, through the Minister for Economic Affairs,

DECREES the following:

REFORMS TO THE LAW ON PLANT AND ANIMAL HEALTH

Art. 1.- In Art. 2, the letter (n) is hereby added as follows:

"(n) Recognize by means of an Executive Decree, inspection services, veterinary services, food safety and phytosanitary surveillance of pests and quarantine diseases of countries that export products or by-products or animal or plant origin that so request and that comply with the procedure established in the Regulations of the present Law."

Art. 2.- Art. 13 is hereby amended as follows:

"Art. 13.- The Ministry of Agriculture and Livestock shall establish the rules and procedures for the entry and transport into and out of the national territory of plants and animals, their products or by-products and equipment and inputs for agricultural use, with the aim of avoiding the entry into the country ofpests and exotic and quarantine diseases and their spread or establishment.

Only those products and by-products of animal and plant origin from countries whose inspection systems, veterinary services, food safety and phytosanitary surveillance of pests and quarantine diseases haven been assessed and approved by the Department of Plant and Animal Health of the Ministry of Agriculture and Livestock may be imported; in cases where the system of the exporting country may not have been approved, import may only come from plants or establishments approved by the Department of Plant and Animal Health, which for this purpose shall have the following responsibilities:

(a) Establish by means of an Executive Agreement the rules and procedures for the import, transport, production, storage and export of plants and animals and their products or by-products;

(b) Establish the health and safety requirements for imports of animals and plants, their products or by-products, as well as for their movement within the national territory;

(c) Establish places for the import and export of plants and animals and their products or by-products;

(d) Establish means of transport for animals and plants, their products or by-products in transit on the national territory;

(e) Intercept, seize and impose periods and places of quarantine for animals and plants, as well as their products or by-products, that cause suspicion or if pests or exotic diseases are found; if the suspicion is confIrmed, the quarantined goods shall be taken, removed, processed or destroyed;

(f) Determine growing areas, sowing seasons and areas for handling quarantined animals. Establish time periods for the destruction of the residues and stubble and for the slaughter of quarantined animals, as well as determine the location of internal quarantine posts and other quarantine operations that may be necessary;

(g) Submit to the relevant international agencIes the Declaration of a pest- or disease-free country or area; and

(h) Create a registry for countries whose systems have been recognized, as well as the registry of authorized products for import to EI Salvador, which should be published in the Official Journal (Diario Oficial) and the website, of which the list will be extended as new systems are recognized or new products accepted for import.

Animals, plants, their products by-products, as well as inputs of animal and plant origin and any other product regulated by the Ministry of Agriculture and Livestock, which have been introduced into the national territory do not have the relevant permission of the Department of Plant and Animal Health and avoid the inspection points or whose origin could not be determined shall be submitted to the Department for relevant analysis. If the analyses carried out by the Department reveal that they are not fit for human consumption or represent a risk for the health status of the country, the Department shall destroy them following a duly reasoneddecision stating the above-mentioned reasons and ordering the measure for the relevant effects, and this shall be duly notified. If the analyses reveal that the products are fit for human consumption or are determined not to pose a risk for the country's health status, they shall be placed under the order of the competent authority for the purposes of this Law."

Art. 3.- Letter (d) of Art. 26 is hereby amended as follows:

"(d) Failing to comply with the plant and animal health requirements laid down by the Ministry of Agriculture and Livestock for the import and export of plants and animals, their products or by-products and agricultural inputs; in which case a fine of between 100 and 10,000 times the minimum wage;"

Art. 4.- The present Decree shall enter into force eight days following its publication in the Official Journal.

REFORMAS A LA LEV DE SANIDAD VEGETAL V ANIMAL

Decreto Legislativo No. 917, del 15 de diciembre de 2005

LA ASAMBLEA LEGISLATIVA DE LA REPUBLICA DE EL SALVADOR,

CONSIDERANDO:

I. Que mediante Decreto Legislativo N°. 524, de fecha 30 de noviembre de 1995, publicado en el Diario Oficial N°. 329, del18 de diciembre de ese mismo ano, se emitio la Ley de Sanidad Vegetal y Animal;

II. Que la precitada ley establece una serie de medidas y requisitos para la importacion y exportacion de productos vegetales, animales y otros, especialmente para la proteccion de la salud de los consumidores, asf como la proteccion del patrimonio sanitario del pafs;

III. Que los procesos modernos de produccion y comercio de los productos y sub-productos de origen animal y vegetal, demandan la modernizacion del Estado en su organizacion y estructura fitosanitaria y zoosanitaria, para atender las exigencias del comercio internacional de productos agropecuarios;

IV.
Que no confiriendole la referida ley potestad al Ministerio de Agricultura y Ganaderfa, en cuanto a reconocer sistemas de inspeccion a terceros pafses con los que se tiene comercio de productos de origen vegetal y animal, es necesario reformarla en tal sentido, armonizando las demas disposiciones de la misma, a efecto de estar acorde con las nuevas realidades del comercio de productos y subproductos de origen animal y vegetal;
V.
Que ademas, el Tratado de Libre Comercio entre Centroamerica, Republica Dominicana y los Estados Unidos de America, ratificado mediante Decreto Legislativo N°. 555, de fecha 17 de diciembre de 2004, publicado en el Diario Oficial N°. 17, Tomo 366, del 25 de enero de 2005, contiene disposiciones que modifican la ley relacionada en el primer considerando; por 10 que con el proposito de adecuar la legislacion nacional a las disposiciones establecidas en el Tratado, es necesario reformar la Ley de Sanidad Vegetal y Animal.

POR TANTO,

En uso de sus facultades constitucionales y a iniciativa del Presidente de la Republica, por medio del Ministro de Agricultura y Ganaderfa,

DECRETA las siguientes:

REFORMAS A LA LEV DE SANIDAD VEGETAL V ANIMAL

Art. 1.-Adicionase en el Art. 2, la letra n), de la manera siguiente:

"n) Reconocer por medio de Decreto Ejecutivo, los sistemas de inspeccion, servicios veterinarios, inocuidad alimentaria y vigilancia fitosanitaria de plagas y enfermedades cuarentenarias de los pafses exportadores de productos y subproductos de origen animal 0 vegetal que asf 10 solicitaren y que cumplieren con el procedimiento establecido en el reglamento de la presente ley."

Art. 2.-Reformase el Art. 13, de la manera siguiente:

"Art. 13.-EI Ministerio de Agricultura y Ganaderfa, dictara las normas y establecera los procedimientos para el ingreso y transporte hacia y dentro del territorio nacional de vegetales y animales, sus productos y sub-productos y de equipos e insumos para uso agropecuario, con la finalidad de evitar el ingreso al pafs de plagas y enfermedades exoticas y cuarentenarias 0 su diseminacion y establecimiento.

Solamente pod ran importarse productos y sub-productos de origen animal y vegetal provenientes de pafses cuyos sistemas de inspeccion, servicios Veterinarios, Inocuidad Alimentaria y vigilancia fitosanitaria de pia gas y enfermedades cuarentenarias, hayan sido evaluados y aprobados por la Direccion General de sanidad Vegetal y Animal, DGsVA del MAG; en los casos en que no se haya eventualmente aprobado el sistema del pafs exportador, la importacion solo podra provenir de plantas 0 establecimientos aprobados por la DGsVA, para ello tendra las siguientes atribuciones:

a) Dictar mediante Acuerdo Ejecutivo las normas y procedimientos para la importacion, transporte, produccion, almacenamiento y exportacion de vegetales y animales, sus productos y subprod uctos;

b) Establecer los requisitos higienico-sanitarios para las importaciones de animales y vegetales, sus productos y subproductos, asf como para la movilizacion de los mismos dentro del territorio nacional;

c) Establecer lugares para la importacion y exportacion de vegetales y animales y de sus productos y subproductos;

d) Establecer vfas para la movilizacion de animales y vegetales, de sus productos y subproductos, en transito por el territorio nacional;

e) Interceptar, decomisar e imponer perfodos y lugares cuarentenarios a los animales y vegetales, asf como sus productos y subproductos, con motivo de sospecha 0 de encontrar pia gas y enfermedades exoticas; al confirmarse la sospecha, procedera a retomar, remover, tratar 0 destruir los bienes cuarentenados;

f) Determinar areas de cultivos, epocas de siembra y areas de manejo de animales cuarentenados. Establecer plazos para la destruccion de resfduos y rastrojos y para el sacrificio de animales sujetos de cuarentena, asf como definir la ubicacion de puestos cuarentenarios internos y demas operaciones cuarentenarias que sean necesarias;

g) Someter a la consideracion de los organismos competentes internacionales, la Declaratoria de Pafs 0 Area Libre de Plagas V Enfermedades; V

h) Crear un registro para los pafses cuvos sistemas les han sido reconocidos, asf como el registro de productos autorizados para su importacion a EI Salvador, el cual debera publicarse en el Diario Oficial V en su sitio Web, cuva lista se ira ampliando en la medida que se reconozcan nuevos sistemas 0 se de la admisibilidad de nuevos productos para su importacion.

Quien ingresare al territorio nacional animales, vegetales, sus productos V subproductos, as! como insumos de origen animal V vegetal 0 cualquier otro producto regulado por el Ministerio de Agricultura V Ganaderfa, que no cuenten con el permiso respectiv~ de la Direccion General de Sanidad Vegetal VAnimal; evadieren los puntos de inspeccion 0 no se pudiere establecer el origen de los mismos; se someteran a los analisis correspondientes en dicha Direccion. Si de los analisis realizados por la DGSVA, estos resultaren no aptos para el consumo humane 0 representaren un riesgo para el estatus sanitario del pafs, esta los destruira, previa resolucion debidamente fundamentada en la

que consten las razones antes descritas V se ordene la diligencia para los efectos correspondientes, la cual debera ser debidamente notificada. Si de los analisis resultaren aptos para el consumo humane 0 se determinare que no representan un riesgo para el estatus sanitario del pafs, estos se pondran a la orden de la autoridad competente para los efectos de lev."

Art. 3.-Reformase en el Art. 26, la letra d), de la manera siguiente:

"d) Incumplir los requisitos fitosanitarios V zoosanitarios senalados por el MAG para la importacion 0 exportacion de vegetales V animales, sus productos V subproductos e insumos agropecuarios; en cuvo caso se impondra una multa de cien a diez mil salarios;"

Art. 4.-EI presente Decreto entrara en vigencia ocho dfas despues de su pUblicaci6n en el Diario Oficial.
