Notes
The notification by South Africa to the WTO under article 63.2 of TRIPS states:
'This Act provides for the protection of performances of literary, musical and artistic works staged in South Africa or in a Rome Convention country where protection is granted to South African performances. The duration of such protection is 20 years.
This Act is in the process of amendment to ensure compliance with provisions of the TRIPS Agreement. Said amendments are aimed at:
(1) Providing for the term of protection under the Act to be extended from 20 years to 50 years;
(2) Making the Act apply retrospectively;
(3) Making certain adjustments to the Act so as to keep abreast with advances in technology and increased usage of electronic and digital storage of information or signals;
(4) Providing for an extension of the definition of 'fixation' to take account of digital technology;
(5) Modernization of certain provisions of the Act.'
