AMENDMENT OF DECREE No. 88-2001, REGLATIONS UNDER THE LAW ON PATENTS FOR INVENTIONS,

UTILITY MODELS AND INDUSTRIAL DESIGNS

DECREE No. 16-2006, adopted on March 9, 2006

THE PRESIDENT OF THE REPUBLIC OF NICARAGUA,

WHEREAS

I

The National Assembly of Nicaragua adopted the Free Trade Agreement between Central America, the United States of America and the Dominican Republic (CAFTA-DR), by means of Legislative Decree No. 4371, published in La Gaceta No. 199 of October 14, 2005.

II

The President of the Republic ratified the Free Trade Agreement between Central America, the United States of America and the Dominican Republic (CAFTA-DR), signed in the city of Washington, D.C., on August 5, 2004, by means of Decree No. 77-2005, published in La Gaceta No. 203 of October 20, 2005.

III

The text of the Free Trade Agreement (CAFTA-DR) envisages in Chapter Fifteen, Article 15.10, measures related to certain regulated goods, which must be aligned with the legal, commercial and administrative framework.

It is necessary to deal with intellectual property aspects and to ensure the implementation of the immediate undertakings to be fulfilled by Nicaragua deriving from the Free Trade Agreement signed, particularly with regard to guaranteeing normative consistency between the normative aspects of the Agreement and our national legislation.

Law No. 354, Law on Patents for Inventions, Utility Models and Industrial Designs, published in La Gaceta No. 179 of September 22, 2000, provides in Article 125 for protection for trade secrets or undisclosed information and test results, submitted to the competent national authority to secure approval for the commercialization of pharmaceutical products or agricultural chemicals containing a new chemical component.

By virtue of the powers conferred on him by the Political Constitution,

HAS ISSUED

The following:

DECREE

Amendment of Decree No. 88-2001, Regulations under the Law on Patents for Inventions, Utility Models and Industrial Designs

Article 1. Amend Article 55 of Decree No. 88-2001, Regulations under the Law on Patents for Inventions, Utility Models and Industrial Designs, published in La Gaceta No. 184 of September 28, 2001, to read as follows:

“Article 55.- Protection of trade secrets or undisclosed information and test results

Trade secrets shall be protected indefinitely and shall combine the following elements: they are secrets insofar as they are not part of the main body or in the precise configuration and pooling of their components, generally known or easily accessible by persons operating in the circles in which the type of information in question is generally used; they possess commercial values as secrets; and they have been the subject of reasonable measures, in the circumstances, for keeping them secret, taken by the person exercising legitimate control over them.

In the event that the submission of undisclosed data on the safety and effectiveness of a new pharmaceutical product or agricultural chemical is a requirement for the approval of the same, the national authority, in accordance with Article 125 of Law No. 354, Law on Patents for Inventions, Utility Models and Industrial Designs, shall guarantee that third parties who do not have the authorization of the person providing the information may not use, for commercial purposes, the information or the approval granted to the person presenting the information, during a period of five years for pharmaceutical products and ten years for agricultural, chemicals, pursuant to the provisions of Article 15.10 of the Free Trade Agreement between Central America, the United States of America and the Dominican Republic (CAFTA-DR).

“National authority” shall be understood as the Pharmacy Division of the Ministry of Health (MINSA), for new pharmaceutical products for human use and/or the Department for Agricultural and Livestock Protection and Health (DGPSA) of the Ministry for Agriculture, Livestock and Forests (MAGFOR), for new pharmaceutical products for veterinary use and agricultural chemicals.”

Article 2. The ministers of the government agencies indicated in the previous article shall issue their respective administrative procedures within their purview, in accordance with the functions vested in them by the respective Law, within a maximum of 15 days, to ensure effective compliance with the provisions of the Free Trade Agreement between Central America, the United States of America and the Dominican Republic (CAFTA-DR), with regard to the protection of undisclosed information and test results; these procedures shall be published in La Gaceta.

Article 3. This Decree shall enter into force upon publication in La Gaceta.

REFORMA AL DECRETO No. 88-2001, REGLAMENTO DE LA LEY DE PATENTES DE INVENCIÓN, MODELO DE UTILIDAD Y

DISEÑOS INDUSTRIALES

DECRETO No. 16-2006, Aprobado el 09 de Marzo del 2006

EL PRESIDENTE DE LA REPÚBLICA DE NICARAGUA,

CONSIDERANDO

I

Que la Asamblea Nacional de Nicaragua aprobó el Tratado de Libre Comercio entre Centroamérica- Estados Unidos de América-República Dominicana (CAFTA-DR), mediante Decreto Legislativo No. 4371, publicado en La Gaceta, Diario Oficial No. 199 del 14 de octubre de 2005.

Que el Presidente de la República ratificó el Tratado de Libre Comercio Centroamérica-Estados Unidos de América-República Dominicana (CAFTA-DR), suscrito en la ciudad de Washington, Distrito de Columbia, el día 5 de agosto del año 2004, mediante Decreto No. 77-2005, publicado en La Gaceta, Diario Oficial No. 203 del 20 de octubre de 2005.

Que el texto del Tratado de Libre Comercio (CAFTA-DR) contempla en su Capítulo Quince, artículo 15.10 medidas relacionadas con ciertos productos regulados, las que deben adecuarse al marco jurídico, comercial y administrativo.

Que es necesario proceder en los aspectos de Propiedad Intelectual, y garantizar la implementación de aquellos compromisos inmediatos a cumplirse por Nicaragua derivados del Tratado Comercial suscrito; particularmente garantizar la congruencia normativa entre los aspectos normativos del tratado y nuestro ordenamiento interno.

Que la Ley No. 354, Ley de Patentes de Invención, Modelo de Utilidad y Diseños Industriales, publicada en La Gaceta, Diario Oficial No. 179 del 22 de septiembre de 2000, establece en su artículo 125 protección a los secretos empresariales o información no divulgada y datos de prueba, presentados ante la autoridad nacional competente para la aprobación de comercialización de productos farmacéuticos o químicos agrícolas, que contengan un nuevo componente químico.

En uso de las facultades que le confiere la Constitución Política,

HA DICTADO

El siguiente:

DECRETO

Reforma al Decreto No. 88-2001, Reglamento de la Ley de Patentes de Invención, Modelo de Utilidad y Diseños Industriales

Artículo 1.- Se reforma el artículo 55 del Decreto No. 88-2001, Reglamento de la Ley de Patentes de Invención, Modelo de Utilidad y Diseños Industriales, publicado en La Gaceta, Diario Oficial No. 184 del 28 de septiembre de 2001, que deberá leerse así:

"Artículo 55.- Protección a los Secretos Empresariales o Información No Divulgada y Datos de Prueba.

Los secretos empresariales se protegen indefinidamente y deberán reunir los siguientes elementos: ser secretos en el sentido de que no sean como cuerpo o en la configuración y reunión precisas de sus componentes, generalmente conocidos ni fácilmente accesibles para personas introducidas en los círculos en que normalmente se utiliza el tipo de información en cuestión; tener un valor comercial por ser secretos; y haber sido objeto de medidas razonables, en las circunstancias, para mantenerlos en secreto, tomadas por la persona que legítimamente la controla.

Si como condición para la aprobación de un nuevo producto farmacéutico o químicos agrícolas, se exige la presentación de Datos no divulgados sobre la seguridad y eficacia del mismo, la autoridad nacional de conformidad con el artículo 125 de la Ley No. 354, Ley de Patentes de Invención, Modelo de Utilidad y Diseños Industriales, deberá garantizar que terceros que no cuenten con el consentimiento de la persona que proporciona la información, utilice con fines comerciales, la información o la aprobación otorgada a la persona que presentó la información, durante el plazo de cinco años para productos farmacéuticos y diez años para productos químicos agrícolas, de conformidad con lo establecido en el artículo 15.10 del Tratado de Libre Comercio Centroamérica- Estados Unidos de América-República Dominicana (CAFTA-DR).

Por autoridad nacional se entenderán, la División de Farmacia del Ministerio de Salud (MINSA), para los nuevos productos farmacéuticos de uso humano y/o la Dirección General de Protección y Sanidad Agropecuaria (DGPSA) del Ministerio Agropecuario y Forestal (MAGFOR), para los nuevos productos farmacéuticos de uso veterinario y químicos agrícolas."

Artículo 2.- Se faculta a los ministros de las dependencias gubernamentales indicadas en el artículo anterior, emitir sus respectivos procedimientos administrativos en el ámbito de su competencia, de conformidad a las funciones que la Ley respectiva les otorga, en un plazo no mayor de quince días, para el efectivo cumplimiento de las disposiciones del Tratado de Libre Comercio Centroamérica- Estados Unidos de América-República Dominicana (CAFTA-DR), en lo relativo a la protección no divulgada y datos de prueba; los que deberán ser publicados en La Gaceta, Diario Oficial.

Artículo 3.- El presente Decreto entrará en vigencia a partir de su publicación en La Gaceta, Diario Oficial.
