Ordonnance fixant la valeur litigieuse déterminante dans les procédures en matière de protection des consommateurs et de concurrence déloyale* du 14 décembre 1987

Le Conseil fédéral suisse,

vu l’article 31sexies, 3e alinéa, de la constitution fédérale1);

vu l’article 13 de la loi fédérale du 19 décembre 19862) contre la concurrence déloyale,

arrête:

Article premier Procédure en matière de protection des consommateurs Les cantons établissent une procédure de conciliation ou une procédure judiciaire simple et rapide s’appliquant, jusqu’à concurrence d’une valeur litigieuse de 8000 francs, aux différends qui découlent de contrats conclus entre consommateurs et fournisseurs. La valeur litigieuse se détermine d’après le montant de la demande, quelles que soient les conclusions reconventionnelles.

Art. 2 Procédures en matière de concurrence déloyale L’article premier s’applique par analogie aux litiges en matière de concurrence déloyale. La procédure est applicable également aux contestations sans valeur litigieuse.

Art. 3 Abrogation du droit en vigueur L’ordonnance du 19 mai 19823) fixant la valeur litigieuse déterminante dans les procédures en matière de protection des consommateurs est abrogée.

Art. 4 Entrée en vigueur La présente ordonnance entre en vigueur le 1er mars 1988.
