Ministerial Decree No. 570 of 2006

The Minister of Agriculture and Land Reclamation,

Having reviewed -The Intellectual Property Rights Law promulgated by Law No. 82 of 2002; -Prime Ministerial Decree No. 1366 of 2003 promulgating the Executive

Regulations of Law No. 82 of 2002; -Prime Ministerial Decree No. 492 of 2003 establishing the Plant Variety Protection Office; -Decree of the Minister of Agriculture and Land ReclamationNo. 1920 of 2003, establishing the National Genebank; -Decree of the Minister of Agriculture and Land Reclamation No. 862 of 2005, on the National Genebank and the genetic resources, and -Upon the proposal of the Head of the Central Administration for Seed Certification

Decreed

Article I

The National Genebank shall accept the deposition of samples representing varieties subject of protection applications, on the responsibility of the applicant, according to Article 158, 3 of Prime Ministerial Decree No. 1366 of 2003.

Article II

The National Genebank shall maintain a Register recording the samples deposited for the purposes of plant variety protection. The Register shall include deposition date; variety genre and proposed designation; and the name and address of the depositor. If the deposited sample is seeds, the germination percentage, the germination test date, and the serial number of the plant variety protection application shall be recorded too.

Article III

The National Genebank shall, within one week from the date of depositing the proposed plant variety’s sample, a protection certificate according to annex 1 or 2, whichever is more suitable to the propagation material.

Article IV

The National Genebank shall, within one week from the date of depositing the proposed plant variety’s sample, a certificate proving the recording of the plant variety on the form in annex 3 (Data recording in the Register).

Article V

The documents annexed hereto, designed for the National Genebank, shall be used for

the implementation of articles 1-4 hereof: -Annex 1: Certificate of Deposit of a Sample of Seed -Annex 2: Certificate of Deposit of a Sample of Vegetative Plant Material -Annex 3: Certificate of an Entry in the Reigster

Article VI

Decrees contradicting with the current decree shall be abolished.

Article VII

The current decree shall be published in the Official Gazette and shall be come intro force as of the day following the date of publication.

NATIONAL GENEBANK

Certificate of Deposit of a Sample of Seed for the Purposes of Article 158 3. of the Implementing Regulations made under Book 4 of Law No 82 of 2002

The Depositor hereby undertakes to allow representatives of the National Genebank access to the designated tree/vine on giving reasonable notice and to permit the National Genebank to take samples of vegetative material for the purposes of maintenance and conservation.

This certificate was granted to the depositor according to Article 158 3 of the Regulations of Book 4 of Law 82/02.
