His Excellency the Governor General in Council, on the recommendation of the

Minister of Industry, pursuant to subsection 68.1(5) of the Copyright Act, hereby

makes the annexed Definition of “Wireless Transmission System” Regulations.

Expression Defined 1 For the purposes of section 68.1 of the Copyright Act, wireless transmission

system means a system operated by a terrestrial radio station that transmits in

analog or digital mode a signal containing performers’ performances of musical

works or sound recordings embodying the performers’ performances, in analog or

digital form, whether in the A.M. or F.M. frequency band or in any other range

assigned by the Minister under section 5 of the Radiocommunication Act, without

artificial guide for free reception by the public.

Coming into Force 2 These Regulations come into force on May 28, 1998.

Sur recommandation du ministre de l’Industrie et en vertu du paragraphe 68.1(5) de la Loi sur le droit d’auteur, Son Excellence le Gouverneur général en conseil prend le Règlement sur la définition de « système de transmission par ondes radioélectriques », ci-après.

Définition 1 Pour l’application de l’article 68.1 de la Loi sur le droit d’auteur, système de transmission par ondes radioélectriques s’entend d’un système exploité par une station terrestre de radio qui transmet en mode analogique ou numérique un signal porteur de prestations d’oeuvres musicales ou d’enregistrements sonores constitués de ces prestations, sous forme analogique ou numérique, dans la bande de fréquences AM ou FM ou toute autre gamme de fréquence attribuée par le ministre aux termes de l’article 5 de la Loi sur la radiocommunication, sans guide artificiel aux fins de la réception à titre gratuit par le public.

Entrée en vigueur 2 Le présent règlement entre en vigueur le 28 mai 1998.
