EXPOSICIÓ DE MOTIUS

Aquesta Llei desplega l’article 40 de la Llei de marques, aprovada el dia 11 de maig de 1995, que estableix que les taxes que es requereixen per al registre i per a la renovació d’una marca, com també per a tota altra inscripció establerta en la Llei, així com per a tot servei que pugui efectuar l’Oficina de Marques, segons estableixi el Reglament d’execució, es fixaran per una llei posterior.

Article 1. Creació

Es crea una taxa per raó dels serveis prestats per l’Oficina de Marques, que es regeix per la present Llei i, si és el cas, per les disposicions reglamentàries que la despleguin.

Article 2. Fet generador

Constitueix el fet generador la recepció dels serveis prestats per l’Oficina de Marques que especifica l’article 5 de la present Llei.

Article 3. Obligat tributari

L’obligat tributari de la taxa és la persona física o jurídica, nacional o estrangera, que sol· licita i rep un dels serveis constitutius de fet generador.

Article 4. Meritament i pagament

  1. L’obligació de contribuir neix, i la corresponent quota tributària s’ha de pagar, en el moment de sol· licitar la prestació d’un dels serveis constitutius de fet generador.

  2. En qualsevol cas el servei no es presta fins que la taxa no sigui percebuda per l’Oficina de Marques.

Article 5. Tarifa de quotes

Les quotes tributàries dels serveis prestats per l’Oficina de Marques són: 1) Serveis de registre i renovació: a) Quota per registre o renovació per a productes o serveis corresponents a 1, 2 o 3 classes de la Classificació de Niça: 20.000 PTA. b) Quota per registre o renovació per cada classe addicional per sobre la tercera:

3.000 PTA. c) Quota addicional per registre o renovació d’una marca col· lectiva: 3.000 PTA. d) Quota addicional per renovació dins el termini de gràcia segons l’article 13.3) de

la Llei de marques de l’11 de maig de 1995: 50 % de la quota de renovació.

2) Serveis complementaris: a) Quota addicional per reivindicació d’un dret de prioritat: 3.000 PTA. b) Quota addicional per marca figurativa en blanc i negre: 3.000 PTA. c) Quota addicional per marca figurativa i en color: 5.000 PTA. d) Quota addicional per marca en color: 3.000 PTA.

3) Serveis d’inscripció i modificació:

a) Quota per inscripció de cessió, quota per registre: 15.000 PTA.

b) Quota per inscripció de concessió de llicència, o de pignoració, o de traspàs, o d’una altra inscripció, quota per registre: 5.000 PTA. c) Quota per inscripció d’una modificació relativa al nom del titular, o a l’adreça del titular, quota per registre: 5.000 PTA. d) Quota per inscripció d’una renúncia, quota per registre: 5.000 PTA. e) Quota per correcció d’error, quota per registre: 5.000 PTA. 4) Serveis de certificació: a) Quota per certificació de la classificació de productes o serveis: 350 PTA per paraula amb un mínim de 7.000 PTA per certificat de classificació. b) Reducció per certificació de la classificació de productes o serveis feta en base a una proposta de classificació: 60 %. 5) Serveis per acreditar la persona mandatària: Quota per examen, acreditació i inscripció registral de la persona mandatària:

100.000 PTA.

Article 6. Retorn de les taxes

Les quotes pagades han de ser retornades d’ofici a la persona sol· licitant si el servei no es presta per causa imputable a l’Oficina de Marques.

Article 7. Gestió

La liquidació i la recaptació de la taxa correspon a l’Oficina de Marques d’acord amb el reglament que aprovi el Govern.

Disposició addicional

La Llei del pressupost general podrà actualitzar les quotes tributàries de les taxes de l’Oficina de Marques fixades en la present Llei.

Disposicions final primera

El Govern establirà les disposicions reglamentàries necessàries per a l’aplicació d’aquesta Llei.

Disposició final segona

Aquesta Llei entra en vigor l’endemà de la seva publicació al Butlletí Oficial del Principat d’Andorra.

Taxation Law of the Office of Trademarks

Introduction

This Law develops Article 40 of the Trademark Law, passed on May 11, 1995, which stipulates that all fees payable for the registration and renewal of a trademark and for any other registration provided for in this Law and for any services that may be rendered by the Trademark Office under the Regulations shall be laid down in subsequent legislation.

Article 1. Creation

Fees shall be paid for services rendered by the Trademark Office, and shall be governed by this Law and by the rules and regulations, if any, derived therefrom.

Article 2. Cause for payment

Receipt of services rendered by the Trademark Office shall be cause for payment of the fees established in Article 5 of this law.

Article 3. Liability for payment(1)

Natural persons or legal entities, whether national or foreign, who apply for and receive any of the services subject to fees shall be liable for payment of these fees.

Article 4. Incurrence and payment(2)

1) The obligation to pay is incurred at the moment of application to receive one of the services that constitute cause for payment and the corresponding fee shall be paid at this time.

2) Under no circumstances shall the service be rendered until the fee has been received by the Trademark Office.

Article 5. Fees

The fees for services rendered by the Trademark Office are:

1) Registration and renewal services:

a) Fee for registration or renewal for goods or services corresponding to 1, 2, or 3 classes of the Nice Classification: 20,000 PTA. b) Fee for registration or renewal for every class over and above three: 3,000 PTA. c) Surcharge fee for registration or renewal of a collective trademark: 3,000 PTA. d) Surcharge fee for renewal within the grace period established in Article 13.3) of the Trademark Law of May 11, 1995: 50% of the renewal fee.

2) Complementary services:

a) Surcharge fee for claim of a priority right: 3,000 PTA. b) Surcharge fee for a black-and-white figurative trademark: 3,000 PTA. c) Surcharge fee for a figurative trademark in color: 5,000 PTA. d) Surcharge fee for a color trademark: 3,000 PTA.

3) Registrations and modifications:

a) Fee for registration of an assignment, fee per registration: 15,000 PTA.

b) Fee for registration of a licensing contract, pledge, transfer or other registration, fee per registration: 5,000 PTA. c) Fee for registration of a change in the name or address of the owner, fee per registration: 5,000 PTA. d) Fee for registration of renunciation, fee per registration: 5,000 PTA. e) Fee for correcting an error, fee per registration: 5,000 PTA.

4) Certifications :(1)

a) Fee for certifaction of classifications of goods or services: 350 PTA. per word with a minimum charge of 7.000 PTA. per certificate of classification. b) Reduction for certification of classification of goods or services issued on the basis of a classification proposal: 60%.

5) Accreditation of licensed representatives:(2)

Fee for examination, accreditation and registration as a licensed representative: 100,000 PTA.

Article 6. Refunds

Fees paid shall be automatically refunded to the applicant if the service is not rendered for reasons attributable to the Trademark Office.

Article 7. Treasury management

The Trademark Office shall be responsible for payment and collection of fees in accordance with the regulations approved by the Government.

Additional Provision(3)

The General Budget Act shall be entitled to update the fees for Trademark Office services established herein.

Final provision first

The Government shall establish the provisions necessary for application of this Law.

Final provision second

This Law shall take effect on the date of its publication in the Official Bulletin of the Principality of Andorra.
