COMPETENTA INSTANTELOR JUDECATORESTI TITLUL I Competenta dupa materie

Art. 1
Judecatoriile judeca:

  1. in prima instanta, toate procesele si cererile, in afara de cele date prin lege in competenta altor instante;
  2. plangerile impotriva hotararilor autoritatilor administratiei publice cu activitate jurisdictionala si ale altor organe cu astfel de activitate, in cazurile prevazute de lege;
  3. in orice alte materii date prin lege in competenta lor.

Art. 2
Tribunalul judeca:

1. in prima instanta:

a) procesele si cererile in materie comerciala al caror obiect are o valoare de peste 100.000 lei, precum si procesele si cererile in aceasta materie al caror obiect este neevaluabil in bani;

b) b) procesele si cererile in materie civila al caror obiect are o valoare de peste 500.000 lei, cu exceptia cererilor de imparteala judiciara, a cererilor in materia succesorala, a cererilor neevaluabile in bani si a cererilor privind materia fondului funciar, inclusiv cele de drept comun, petitorii sau, dupa caz, posesorii, formulate de tertii vatamati in drepturile lor prin aplicarea legilor in materia fondului funciar;

c) conflictele de munca, cu exceptia celor date prin lege in competenta altor instante;

d) procesele si cererile in materie de contencios administrativ, in afara de cele date in competenta curtilor de apel;

e) procesele si cererile in materie de creatie intelectuala si de proprietate industriala;

f) procesele si cererile in materie de expropriere;

g) cererile pentru incuviintarea, nulitatea sau desfacerea adoptiei;

h) cererile pentru repararea prejudiciilor cauzate prin erori judiciare savarsite in procesele penale;

i) cererile pentru recunoasterea, precum si cele pentru incuviintarea executarii silite a hotararilor date in tari straine;

  1. ca instante de apel, apelurile declarate impotriva hotararilor pronuntate de judecatorii in prima instanta;
  2. ca instante de recurs, recursurile declarate impotriva hotararilor pronuntate de judecatorii, care, potrivit legii, nu sunt supuse apelului;
  3. in orice alte materii date prin lege in competenta lor.

Art. 3 Curtile de apel judeca:

  1. in prima instanta, procesele si cererile in materie de contencios administrativ privind actele autoritatilor si institutiilor centrale;
  2. ca instante de apel, apelurile declarate impotriva hotararilor pronuntate de tribunale in prima instanta;
  3. ca instante de recurs, recursurile declarate impotriva hotararilor pronuntate de tribunale in apel sau impotriva hotararilor pronuntate in prima instanta de tribunale, care, potrivit legii, nu sunt supuse apelului, precum si in orice alte cazuri expres prevazute de lege;
  4. in orice alte materii date prin lege in competenta lor.

Art. 4 Inalta Curte de Casatie si Justitie judeca:

  1. recursurile declarate impotriva hotararilor curtilor de apel si a altor hotarari, in cazurile prevazute de lege;
  2. recursurile in interesul legii;
  3. Abrogat prin Ordonanta de urgenta a Guvernului nr. 58/2003;
  4. in orice alte materii date prin lege in competenta sa.

Art. 41

Competenta ce revine instantelor judecatoresti in legatura cu arbitrajul reglementat de cartea IV apartine instantei care ar fi fost competenta sa solutioneze litigiul in fond, in lipsa unei conventii arbitrale.

CAP. 2 Sedintele si politia lor

Art. 121

Sedintele vor fi publice, afara de cazurile cand legea dispune altfel.

Instanta poate sa dispuna ca dezbaterile sa se faca in sedinta secreta, daca dezbaterea publica ar putea vatama ordinea sau moralitatea publica sau pe parti. In acest caz, partile vor putea fi insotite, in afara de aparatorii lor, de cel mult doua persoane desemnate de ele.

Hotararea se pronunta intotdeauna in sedinta publica.
