Commission Regulation (EC) No. 1845/2004 of 22 October 2004 supplementing the Annex to Regulation (EC) No. 2400/96 on the entry of certain names in the ‘Register of protected designations of origin and protected geographical indications’ (Tergeste, Lucca, Miele della Lunigiana and Άγιος Ματθαίος Κέρκυρας (Agios Mathaios Kerkyras)), European Union (EU)

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Council Regulation (EEC) No 2081/92 of 14 July 1992 on the protection of geographical indications and designations of origin for agricultural products and foodstuffs (¹), and in particular Article 6(3) and (4) thereof,

Whereas:

Pursuant to Article 5 of Regulation (EEC) No 2081/92, Italy has sent the Commission applications for the registration of the names ‘Tergeste’, ‘Miele della Lunigiana’ and ‘Lucca’ as designations of origin; Greece has sent the Commission an application for the registration of the name ‘Άγιος Ματθαίος Κέρκυρας’ (Agios Mathaios Kerkyras) as a geographical indication.

In accordance with Article 6(1) of that Regulation, the applications have been found to meet all the requirements laid down therein and in particular to contain all the information required in accordance with Article 4 thereof.

No statement of objection, within the meaning of Article 7 of Regulation (EEC) No 2081/92, has been sent to the Commission following the publication in the Official Journal of the European Union (²) of the names listed in the Annex to this Regulation.

(4)

The names consequently qualify for inclusion in the ‘Register of protected designations of origin and protected geographical indications’ and for protection at Community level as a protected designation of origin or protected geographical indication.

(5)

The Annex to this Regulation supplements the Annex to Commission Regulation (EC) No 2400/96 (³),

HAS ADOPTED THIS REGULATION:

Article 1

The names listed in the Annex to this Regulation are hereby added to the Annex to Regulation (EC) No 2400/96 and entered as protected designations of origin (PDO) and a protected geographical indication (PGI) in the ‘Register of protected designations of origin and protected geographical indications’ provided for in Article 6(3) of Regulation (EEC) No 2081/92.

Article 2

This Regulation shall enter into force on the 20th day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Visto el Reglamento (CEE) n^o 2081/92 del Consejo, de 14 de julio de 1992, relativo a la protección de las indicaciones geográficas y de las denominaciones de origen de los productos agrícolas y alimenticios (¹), y, en particular, los apartados 3 y 4 de su artículo 6,

Considerando lo siguiente:

De conformidad con el artículo 5 del Reglamento (CEE) n^o 2081/92, Italia ha transmitido a la Comisión tres solicitudes de registro de denominación de origen protegida para las denominaciones «Tergeste», «Miele della Lunigiana» y «Lucca»; Grecia ha transmitido una solicitud de registro de indicación geográfica protegida para la denominación «Άγιος Ματθαίος Κέρκυρας» (Agios Mathaios Kerkyras).

Se ha comprobado, con arreglo a lo dispuesto en el apartado 1 del artículo 6 del citado Reglamento, que dichas solicitudes son conformes con lo dispuesto en el Reglamento y, en particular, que incluyen todos los elementos previstos en su artículo 4.

La Comisión no ha recibido ninguna declaración de oposición en el sentido del artículo 7 del Reglamento (CEE) n^o 2081/92 a raíz de la publicación en el Diario Oficial de la Unión Europea (²) de las denominaciones que figuran en el anexo del presente Reglamento.

Por consiguiente, las denominaciones mencionadas merecen que se inscriban en el Registro de Denominaciones de Origen Protegidas y de Indicaciones Geográficas Protegidas y que se protejan a escala comunitaria en su calidad de denominación de origen protegida o indicación geográfica protegida.

El anexo del presente Reglamento complementa el anexo del Reglamento (CE) n^o 2400/96 de la Comisión (³).

HA ADOPTADO EL PRESENTE REGLAMENTO:

Artículo 1

El anexo del Reglamento (CE) n^o 2400/96 se complementará con las denominaciones que figuran en el anexo del presente Reglamento y que se inscribirán en calidad de denominación de origen protegida (DOP) o indicación geográfica protegida (IGP) en el Registro de Denominaciones de Origen Protegidas y de Indicaciones Geográficas Protegidas, previsto en el apartado 3 del artículo 6 del Reglamento (CEE) n^o 2081/92.

Artículo 2

El presente Reglamento entrará en vigor el vigésimo día siguiente al de su publicación en el Diario Oficial de la Unión Europea.

El presente Reglamento será obligatorio en todos sus elementos y directamente aplicable en cada Estado miembro.

vu le règlement (CEE) n^o 2081/92 du Conseil du 14 juillet 1992 relatif à la protection des indications géographiques et des appellations d’origine des produits agricoles et des denrées alimentaires (¹), et notamment son article 6, paragraphes 3 et 4,

considérant ce qui suit:

Conformément à l’article 5 du règlement (CEE) n^o 2081/92, l’Italie a transmis à la Commission trois demandes d'enregistrement en tant qu’appellation d’origine pour les dénominations «Tergeste», «Miele della Lunigiana» et «Lucca»; la Grèce a transmis à la Commission une demande d’enregistrement en tant qu’indication géographique pour la dénomination «Άγιος Ματθαίος Κέρκυρας» (Agios Mathaios Kerkyras).

Il a été constaté, conformément à l’article 6, paragraphe 1, dudit règlement, qu’elles sont conformes à ce règlement, notamment qu’elles comprennent tous les éléments prévus à son article 4.

Aucune déclaration d’opposition, au sens de l’article 7 du règlement (CEE) n^o 2081/92, n’a été transmise à la Commission à la suite de la publication au Journal officiel de l’Union européenne (²) des dénominations figurant à l’annexe du présent règlement.

En conséquence, ces dénominations méritent d’être inscrites dans le «Registre des appellations d’origine protégées et des indications géographiques protégées» et donc d’être protégées sur le plan communautaire en tant qu’appellation d’origine protégée ou indication géographique protégée.

L’annexe du présent règlement complète l’annexe du règlement (CE) n^o 2400/96 (³),

A ARRÊTÉ LE PRÉSENT RÈGLEMENT:

Article premier

L’annexe du règlement (CE) n^o 2400/96 est complétée par les dénominations figurant à l’annexe du présent règlement et ces dénominations sont inscrites en tant qu’appellation d’origine protégée (AOP) ou indication géographique protégée (IGP), dans le «Registre des appellations d’origine protégées et des indications géographiques protégées» prévu à l’article 6, paragraphe 3, du règlement (CEE) n^o 2081/92.

Article 2

Le présent règlement entre en vigueur le vingtième jour suivant celui de sa publication au Journal officiel de l’Union européenne.

Le présent règlement est obligatoire dans tous ses éléments et directement applicable dans tout État membre.
