Lege nr. 214/2008 pentru completarea Ordonantei de urgenta a Guvernului nr. 100/2005 privind asigurarea respectarii drepturilor de proprietate industriala

Art. I

Ordonanta de urgenta a Guvernului nr. 100/2005 privind asigurarea respectarii drepturilor de proprietate industriala, publicata in Monitorul Oficial al Romaniei, Partea I, nr. 643 din 20 iulie 2005, aprobata cu modificari prin Legea nr. 280/2005, se completeaza dupa cum urmeaza:

La articolul 4, dupa litera b) se introduce o noua litera, litera c), cu urmatorul cuprins:

"c) persoanele titulare ale unui drept de proprietate industriala protejat printr-un brevet de inventie acordat de statul roman si succesorii lor in drept, detinut in perioada 6 martie 1945 - 22 decembrie 1989, carora le-au fost incalcate drepturile patrimoniale conferite de brevet prin exploatarea inventiei in mod abuziv, fara consimtamantul titularului sau prin orice fapte de incalcare a drepturilor acestuia."

Dupa articolul 4 se introduce un nou articol, articolul 41, cu urmatorul cuprins:

"Art. 41. - (1) Actiunile in justitie introduse de persoanele prevazute la art. 4 lit. c) sunt scutite de la plata taxelor de timbru.

(2) Litigiile avand ca obiect masurile reparatorii pentru persoanele prevazute la art. 4 lit. c) sunt de competenta Tribunalului Bucuresti."

Art. II

(1) La determinarea perioadei inauntrul careia un brevet, dintre cele prevazute la art. 4 lit. c) din Ordonanta de urgenta a Guvernului nr. 100/2005 privind asigurarea respectarii drepturilor de proprietate industriala, cu modificarile ulterioare, trebuia sa fie exploatat, nu se va tine seama de perioada dintre instaurarea regimului comunist in Romania si intrarea in vigoare a prezentei legi, perioada care va fi considerata ca o prelungire in mod automat a termenului de revendicare a drepturilor decurgand din brevetul de inventie.

(2) In raporturile juridice privind persoanele prevazute la art. 4 lit. c) din Ordonanta de urgenta a Guvernului nr. 100/2005, cu modificarile ulterioare, care nu au putut sa introduca sau sa continue o actiune juridica ori sa indeplineasca formalitatile necesare pentru valorificarea drepturilor lor ca urmare a masurilor si a legislatiei restrictive impuse de regimul comunist instaurat in Romania dupa 6 martie 1945, toate termenele de prescriptie sau de limitare a dreptului de a introduce ori de a continua o actiune juridica sau de a lua masuri de conservare vor fi considerate ca fiind suspendate, indiferent daca aceste termene au inceput sa curga inainte sau dupa data de 6 martie 1945. Aceste termene vor reincepe sa curga de la data intrarii in vigoare a prezentei legi.

Art. III

Prezenta lege intra in vigoare in termen de 30 de zile de la data publicarii in Monitorul Oficial al Romaniei, Partea I.
