Details Details Year of Version 1997 Dates Entry into force: November 11, 1997 Adopted: November 11, 1997 Published: November 11, 1997 Type of Text Main IP Laws Subject Matter Genetic Resources Notes Decision No. 421 was issued by the Commission of the Andean Community (also called the ‘Commission of Cartagena Agreement’) on November 11, 1997, and published in the Cartagena Agreement Official Gazette No. 305 of November 18, 1997. The Sole Article of the said amending Decision No. 421 amended the Eighth Transitory/Temporary Disposition of Decision 391 where the words "within a period of three months" are replaced by the words "within one year". Following this amendment, the Board shall draw up, within one year from the date of the entry into force of Decsion No. 391 the Member Countries shall present their national studies, a proposal to establish a special regime or a harmonization regulation, as applicable, aimed at reinforcing the protection of know-how, innovations and traditional practices of native, Afro-American and local communities, in keeping with the provision of Article 7 of this Decision, ILO Convention 169 (relating to Indigenous and Tribal Peoples )and the Agreement on Biological Diversity.

Modificación de la Octava Disposición Transitoria de la Decisión 391: Régimen Común sobre Acceso a los Recursos Genéticos

LA COMISION DE LA COMUNIDAD ANDINA,

VISTOS: La Decisión 391 de la Comisión que contiene el Régimen Común sobre Acceso a los Recursos Genéticos, y la Propuesta 3 del Secretario General; y,

CONSIDERANDO: Que, con fecha 2 de julio de 1996, fue aprobada la Decisión 391 que contiene el Régimen Común sobre Acceso a los Recursos Genéticos, publicada en la Gaceta Oficial del Acuerdo de Cartagena Nº 213 del 17 de julio de 1996;

Que la Octava Disposición Transitoria de la Decisión 391 fijaba el plazo de un año contado a partir de la fecha de su entrada en vigencia, para que los Países Miembros presentaran a la Junta del Acuerdo de Cartagena una propuesta para establecer un régimen especial o una norma de armonización, según correspondiera, que estuviera orientado a fortalecer la protección de los conocimientos, innovaciones y prácticas tradicionales de las comunidades indígenas, afroamericanas y locales, conforme a lo dispuesto en el Artículo 7 de la referida Decisión 391, el Convenio 169 de la OIT y el Convenio sobre la Diversidad Biológica; y,

Que el plazo señalado en la Disposición Transitoria Octava de la Decisión 391 ha resultado insuficiente dada la complejidad del tema en cuestión, por lo que es necesario prorrogarlo para que los Países Miembros puedan cumplir con la obligación allí contenida.

DECIDE:

Artículo Unico.- Modificar el plazo establecido en la Octava Disposición Transitoria de la Decisión 391, Régimen Común sobre Acceso a los Recursos Genéticos, al 29 de febrero de 1998.

Dada en la ciudad de Lima, Perú, a los once días del mes de noviembre de mil novecientos noventa y siete.
