Declaration of Senegal concerning the Protocol Regarding Developing Countries

The Director of the United International Bureaux for the Protection of Intellectual Property (BIRPI) presents his compliments to the Minister for Foreign Affairs and, in conformity with the provisions of the Stockholm Act of the Berne Convention for the Protection of Literary and Artistic Works, has the honor to notify him of the declaration deposited by the Republic of Senegal and whose operative part is couched in the following terms:

(Original) "...Se référant aux articles 1 et 5 du Protocole relatif aux pays en voie de développement, formant partie intégrante de l'Acte de Stockholm de la Convention de Berne pour la protection des œuvres littéraires et artistiques, le Gouvernement du Sénégal entend appliquer les dispositions de ce Protocole aux œuvres dont le pays d'origine est un pays membre de l'Union de Berne qui sera devenu lie par les articles 1 à 21 dudit Acte et par le Protocole ou qui admettra une telle application, conformément à l'article 5 précité...".

(BIRPI Translation) "... With reference to Articles 1 and 5 of the Protocol Regarding Developing Countries which forms an integral part of the Stockholm Act of the Berne Convention for the Protection of Literary and Artistic Works, the Government of Senegal intends to apply the provisions of that Protocol to works whose country of origin is a country of the Berne Union which will become bound by Articles 1 to 21 of the said Act and by the Protocol, or which, will admit such application in conformity with the aforesaid Article 5..."

By virtue of Article 5(2) of the Protocol Regarding Developing Countries, this declaration becomes effective from the date it is deposited, i.e., November 14, 1967. However, it will be applicable only in respect of countries members of the Berne Union which have admitted the application of the reservations permitted under the said Protocol.

It should, be noted that, to date, no declaration by any country admitting such application has been made in pursuance of Article 5(1)(b) of the Protocol, and no instrument of ratification or accession relating to Articles 1 to 21 of the Stockholm Act of the Berne Convention and to the Protocol has been deposited with the Director of BIRPI.
