Berne Convention for the Protection of Literary and Artistic Works

Ratification by the Republic of India of the Paris Act (1971) (with the exception of Articles 1 to 21 and the Appendix)

The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and, in accordance with the provisions of the Paris Act (1971) of the Berne Convention for the Protection of Literary and Artistic Works of September 9, 1886, has the honor to notify him that the Government of the Republic of India deposited on October 7, 1974, its instrument of ratification of the said Convention, as revised at Paris on July 24, 1971, with the declaration provided for in Article 28(1)(b) of the said Act to the effect that this ratification shall not apply to Articles 1 to 21 and the Appendix.

Furthermore, the said instrument of ratification contains the following declaration:

"With reference to Article 33 of the Convention, the Government of the Republic of India declare, in accordance with the provision of paragraph (2) of the said Article, that the Government of the Republic of India do not consider themselves bound by the provisions of paragraph (1) of Article 33 of the Convention." (Original).

The Government of the Republic of India, indicated, concurrently with depositing its instrument of ratification, that for the purposes of Article 25(4) of the Paris Act (1971) of the Convention, the Republic of India wished to continue to belong to Class IV.

Pursuant to the provisions of Article 28(3) of the Paris Act (1971) of the said Convention, Articles 22 to 38 will enter into force, with respect to the Republic of India, three months after the date of this notification, that is, on January 10, 1975.
