Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure

Communication by the Government of the United States of America Regarding a Change in the Schedule of Fees Charged by the American Type Culture Collection (ATCC)

The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify him of the receipt, on January 13, 2006, of the communication of the Government of the United States of America, dated January 3, 2006, regarding a change in the schedule of fees charged by the American Type Culture Collection (ATCC), an international depositary authority under the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, done at Budapest on April 28, 1977, and amended on September 26, 1980 (see Budapest Notification No. 11 of December 3, 1980).

According to Rule 12.2(c) of the Regulations under the Budapest Treaty, the fees set forth in the said communication shall take effect on March 3, 2006, that is, on the thirtieth day following the publication of the change by the International Bureau.

Communication by the Government of the United States of America Regarding a Change in the Schedule of Fees Charged by the American Type Culture Collection (ATCC)

COMMUNICATION

We have received a notification from the American Type Culture Collection (ATCC) regarding a new schedule of fees for the furnishing of samples of all cultures deposited with it. In accordance with Rule 12.2(a) of the Regulations under the Budapest Treaty, I am pleased to notify you of the following changes in the fees:


  Furnishing of a sample USD
    - All ATCC Cultures per item
    - US Non-Profit Institutions 86 [1] to 281 [1]
    - Foreign Non-Profit Institutions 86 [1] to 281 [1]
    - Other US and Foreign Institutions 107 [1] to 330 [1]
  Biosafety Level 1 21 to 107
  Biosafety Level 2 90 to 310
  Biosafety Level 3 90 to 310

1. Additional handling and processing - dependent on destination and hazard level

Because of the diversity of ATCC holdings, and the requirements for complicated and varied culture media and growth conditions, the fees for furnishing ATCC cultures vary. Therefore, the current fees have been listed as a range representing all currently available ATCC cultures.
