The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify His Excellency that the following amendments to the Patent Cooperation Treaty (PCT), done at Washington on June 19, 1970, will enter into force on May 3, 1984:
- in Article 53(11) subparagraphs (a) and (b) are replaced by the following text: "(a) the Assembly shall meet in every second calendar year in ordinary session upon convocation by the Director General and, in the absence of exceptional circumstances, during the same period and at the same place as the General Assembly of the Organization." and, at the beginning of the last subparagraph, the letter "(b)" is substituted for the letter "(c)";
- in Article 54(6)(a)(ii), "triennial" is replaced by "biennial";
- in Article 54(6)(a), item (iii) is deleted.
The said amendments were unanimously adopted by the Assembly of the International Patent Cooperation Union (PCT Union), on October 2, 1979 (see document AB/X/32, paragraph 33). The said amendments were reproduced in document AB/X/5, Annex I, and were communicated to the States concerned by Note C.N. 563 of November 14, 1979, as modified by Note C.N. 576 of January 31, 1980.
The entry into force of the said amendments was brought about upon the receipt by the Director General of notifications of acceptance of those amendments by the required number of States members of the said Assembly of the PCT Union at the time the said Assembly adopted those amendments, that is, from three-fourths (18) of the 24 said member States. The said notifications of acceptance were received, in chronological order, from the following 18 States, the date of receipt being indicated after each State: Federal Republic of Germany (December 11, 1979), Denmark (December 24, 1979), Sweden (January 9, 1980), Monaco (January 23, 1980), France (January 31, 1980), Brazil (February 8, 1980), United States of America (June 2, 1980), Romania (June 11, 1980), Switzerland (July 3, 1980), Luxembourg (October 3, 1980), United Kingdom (November 4, 1980), Soviet Union (October 30, 1981), Malawi (March 5, 1982), Central African Republic (September 15, 1983), Congo (October 5, 1983), Netherlands (January 9, 1984), Cameroon (March 26, 1984), Chad (April 3, 1984).
The said amendments bind all the States members of the said Assembly at the time those amendments enter into force, that is: Australia, Austria, Belgium, Brazil, Cameroon, Central African Republic, Chad, Congo, Democratic People's Republic of Korea, Denmark, Finland, France, Gabon, Germany (Federal Republic of), Hungary, Japan, Liechtenstein, Luxembourg, Madagascar, Malawi, Mauritania, Monaco, Netherlands, Norway, Romania, Senegal, Soviet Union, Sri Lanka, Sudan, Sweden, Switzerland, Togo, United Kingdom, United States of America (34), and will bind all other States which become members of that Assembly subsequent to their date of entry into force (see Article 61(3) of the afore-mentioned Treaty).
