The Director General of the World Intellectual Property Organization (WIPO) presents his compliments to the Minister for Foreign Affairs and has the honor to notify the deposit by the Government of New Zealand, on December 17, 2018, of its instrument of accession to the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, done at Budapest on April 28, 1977, and amended on September 26, 1980. The said instrument contained the following declaration:
- "[C]onsistent with the constitutional status of Tokelau and taking into account the commitment of the Government of New Zealand to the development of self‑government for Tokelau through an act of self‑determination under the Charter of the United Nations, this accession shall not extend to Tokelau unless and until a Declaration to this effect is lodged by the Government of New Zealand with the Depositary on the basis of appropriate consultation with that territory."
The Budapest Treaty will enter into force, with respect to New Zealand, on March 17, 2019.
