DECISION
AMENDING AND SUPPLEMENTING DECISION NO. 18/2002/QD-BVHTT OF JULY 29,
2002 PROMULGATING THE REGULATION ON LICENSING, INSPECTION,
EXAMINATION OF, AND HANDLING OF VIOLATIONS IN, THE RECEPTION OF
FOREIGN TELEVISION PROGRAMS
THE MINISTER OF CULTURE AND INFORMATION
Pursuant to the Government's Decree No. 63/2003/ND-CP of June 11, 2003 defining the
functions, tasks, powers and organizational structure of the Ministry of Culture and Information;
Pursuant to the December 28, 1989 Press Law and the June 12, 1999 Law Amending and
Supplementing a Number of Articles of the Press Law;
Pursuant to the Government's Decree No. 51/2002/ND-CP of April 26, 2002 detailing the
implementation of the Press Law and the Law Amending and Supplementing a Number of
Articles of the Press Law;
Pursuant to the Prime Minister's Decision No. 150/2003/QD-TTg of July 22, 2003 amending and
supplementing Decision No. 46/2001/QD-TTg on the management of the goods export and
import in the 2001-2005 period and Decision No. 79/2002/QD-TTg on the management of the
reception of foreign television programs;
At the proposal of the director of the Press Department of the Ministry of Culture and
Information,
DECIDES:
Article 1.- To amend and supplement Article 13, Section E, Chapter I and Articles 14 and 15,
Chapter II of the Regulation on licensing, inspection, examination of, and handling of violations
in, the reception of foreign television programs, promulgated together with Decision No. 18/QD-
BVHTT of July 29, 2003 as follows:
"Section E: Importing and trading in TV Receive Only (TVRO) equipment
Article 13.- The agencies which import and/or trade in TV Receive Only (TVRO) equipment
must apply for permission and obtain written approval from the Ministry of Culture and
Information for each goods lot to be imported and/or traded in.
The agencies and organizations which import and/or trade in TVRO equipment shall have to
submit dossiers of application for permits to import and/or trade in TVRO equipment to the Press
Department, the Ministry of Culture and Information.
A dossier consists of:
- An application for a permit to import and/or trade in TVRO equipment, clearly stating the
importing and/or trading purpose, the names, technical properties and origins of the equipment,
quantities, categories and models thereof.
- Price quotations and catalogs of the equipment and enclosed technical documents;
- A copy of the registration certificate granted by the Ministry of Culture and Information
allowing the applying agency or organization to deal in the installation and repair of TVRO
equipment.
Article 14.- Inspection and examination
The specialized culture and information inspectorate shall perform the function of specialized
inspection according to law provisions.
The Press Department of the Ministry of Culture and Information shall assume the prime
responsibility for, and coordinate with the concerned agencies in, conducting annual or
unexpected examinations of the licensing and use of the permits for reception of foreign
television programs directly from satellites; the import of and trading in TVRO equipment; the
provision and distribution of foreign television program decoders; the installation and repair of
TVRO equipment.
Article 15.- Reporting regime
1. The Culture and Information Services of the provinces and centrally run cities shall have the
responsibilities:
- To send copies of the permits for reception of foreign television programs directly from
satellites, already granted to organizations and individuals in their respective localities, to the
Press Department, the Ministry of Culture and Information.
- To send biannual and annual reports on the granting and use of the permits for reception of
foreign television programs directly from satellites in their respective localities to the Press
Department, the Ministry of Culture and Information.
2. Vietnam-based distributors of foreign television program decoders shall have to send annual
reports on the quantities of decoders already distributed and the subjects provided therewith to
the Press Department of the Ministry of Culture and Information.
3. Agencies and organizations dealing in the installation and repair of TVRO equipment shall
have to send annual reports on the quantities of TVRO equipment they have installed and/or
repaired and the lists and addresses of the subjects that have such equipment installed or repaired
to the Press Department of the Ministry of Culture and Information.
4. Agencies and organizations which import and/or trade in TVRO equipment shall have to send
annual reports on the import and/or trading of TVRO equipment which have been permitted by
the Ministry of Culture and Information for being imported and/or traded in."
Article 2.- The director of the Press Department, the chief inspector of the Ministry of Culture
and Information, the directors of the provincial/municipal Information and Culture Services and
all organizations and individuals shall have to implement this Decision.
Article 3.- This Decision takes effect 15 days after its publication in the Official Gazette.

BỘ TRƯỞNG BỘ VĂN HOÁ - THÔNG TIN Căn cứ Nghị định 63/2003/NĐ-CP ngày 11 tháng 6 năm 2003 của Chính phủ quy định về chức năng, nhiệm vụ, quyền hạn và cơ cấu tổ chức của Bộ Văn hoá - Thông tin; Căn cứ Luật Báo chí ngày 28 tháng 12 năm 1989 và Luật Sửa đổi, bổ sung một số điều của Luật Báo chí ngày 12 tháng 6 năm 1999; Căn cứ Nghị định số 51/2002/NĐ-CP ngày 26 tháng 4 năm 2002 của Chính phủ quy định chi tiết thi hành Luật Báo chí, Luật Sửa đổi, bổ sung một số điều của Luật Báo chí; Căn cứ Quyết định số 150/2003/QĐ-TTg ngày 22 tháng 7 năm 2003 của Thủ tướng Chính phủ về việc sửa đổi, bổ sung Quyết định số 46/2001/QĐ-TTg về quản lý xuất khẩu, nhập khẩu hàng hoá thời kỳ 2001 - 2005 và Quyết định số 79/2002/QĐ-TTg về quản lý việc thu các chương trình truyền hình của nước ngoài; Theo đề nghị của Cục trưởng Cục Báo chí Bộ Văn hóa - Thông tin,
QUYẾT ĐỊNH Điều 1: Sửa đổi, bổ sung Điều 13, Mục E, Chương I và Điều 14, Điều 15 Chương II Quy chế cấp giấy phép, thanh tra, kiểm tra, xử lý vi phạm việc thu chương trình truyền hình nước ngoài ban hành kèm theo Quyết định số 18/QĐ-BVHTT ngày 29 tháng 7 năm 2003 như sau:
"Mục E: Nhập khẩu, kinh doanh các thiết bị thu tín hiệu truyền hình trực tiếp từ vệ tinh (TVRO)
Điều 13:
Cơ quan nhập khẩu, kinh doanh các thiết bị thu tín hiệu truyền hình trực tiếp từ vệ tinh (TVRO) phải xin phép và được sự chấp thuận bằng văn bản của Bộ Văn hoá - Thông tin cho từng lô hàng nhập khẩu, kinh doanh.
Cơ quan, tổ chức nhập khẩu, kinh doanh các thiết bị thu tín hiệu truyền hình trực tiếp từ vệ tinh (TVRO) nộp hồ sơ xin cấp giấy phép nhập khẩu, kinh doanh thiết bị TVRO cho Cục Báo chí Bộ Văn hoá - Thông tin.
Hồ sơ gồm:
- Đơn xin cấp giấy phép nhập khẩu, kinh doanh thiết bị TVRO nêu rõ mục đích nhập khẩu, kinh doanh, tên gọi của thiết bị, tính năng kỹ thuật của thiết bị, nguồn gốc xuất xứ của thiết bị, số lượng, chủng loại, mẫu mã.
- Báo giá, catalog của thiết bị và tài liệu kỹ thuật kèm theo.
- Bản sao Giấy chứng nhận đăng ký cho cơ quan, tổ chức kinh doanh việc lắp đặt, sửa chữa thiết bị thu tín hiệu truyền hình trực tiếp từ vệ tinh (TVRO) do Bộ Văn hoá - Thông tin cấp.
Điều 14: Thanh tra, kiểm tra
Thanh tra chuyên ngành văn hoá - thông tin thực hiện chức năng thanh tra chuyên ngành theo quy định của pháp luật.
Cục Báo chí Bộ Văn hoá - Thông tin có trách nhiệm chủ trì, phối hợp với các cơ quan liên quan tổ chức kiểm tra định kỳ hàng năm hoặc kiểm tra đột xuất việc cấp, sử dụng Giấy phép thu chương trình truyền hình nước ngoài trực tiếp từ vệ tinh; việc nhập khẩu, kinh doanh thiết bị TVRO; việc cung cấp, phân phối các bộ giải mã chương trình truyền hình nước ngoài; việc lắp đặt, sửa chữa thiết bị thu tín hiệu truyền hình trực tiếp từ vệ tinh.
Điều 15: Chế độ báo cáo
1. Sở Văn hoá - Thông tin các tỉnh, thành phố trực thuộc Trung ương có trách nhiệm:
- Gửi một (01) bản Giấy phép thu chương trình truyền nước ngoàỉ trực tiếp từ vệ tinh đã cấp cho các tổ chức, cá nhân trên địa bàn địa phương mình về Cục Báo chí Bộ Văn hoá - Thông tin.
- Thực hiện chế độ báo cáo định kỳ 6 tháng, 1 năm về tình hình cấp, sử dụng Giấy phép thu chương trình truyền hình nước ngoài trực tiếp từ vệ tinh trên địa bàn địa phương mình cho Cục Báo chí Bộ Văn hoá - Thông tin.
2. Các đại diện phân phối tại Việt Nam các bộ giải mã chương trình truyền hình nước ngoài có trách nhiệm báo cáo định kỳ 1 năm về số lượng các bộ giải mã đã cung cấp, các đối tượng được cung cấp về Cục Báo chí Bộ Văn hoá - Thông tin.
3. Các cơ quan, tổ chức kinh doanh việc lắp đặt, sửa chữa thiết bị thu tín hiệu truyền hình trực tiếp từ vệ tinh có trách nhiệm báo cáo định kỳ 1 năm về số lượng và danh sách, địa chỉ của các đối tượng đã được cơ quan, tổ chức thực hiện việc lắp đặt, sửa chữa thiết bị thu tín hiệu truyền hình trực tiếp từ vệ tinh về Cục Báo chí Bộ Văn hoá - Thông tin.
4. Cơ quan, tổ chức nhập khẩu, kinh doanh các thiết bị thu tín hiệu truyền hình trực tiếp từ vệ tinh có trách nhiệm báo cáo định kỳ 1 năm việc nhập khẩu, kinh doanh thiết bị TVRO đã được Bộ Văn hoá - Thông tin cho phép nhập khẩu, kinh doanh."
Điều 2: Cục trưởng Cục Báo chí, Chánh Thanh tra Bộ Văn hoá - Thông tin, Giám đốc Sở Văn hoá - Thông tin tỉnh, thành phố trực thuộc Trung ương và mọi tổ chức, cá nhân chịu trách nhiệm thực hiện Quyết định này.
Điều 3: Quyết định này có hiệu lực thi hành sau 15 ngày, kể từ ngày đăng công báo.
