Year of Version 2001 Dates Entry into force: September 28, 1999 Adopted: August 25, 1999 Type of Text IP-related Laws Subject Matter Trademarks, Competition, Other Notes This Law guarantees the proper functioning of the markets, ensures free competition and sanctions behaviors that limit, restrict or distort competition or that constitute abuse of market position in a way that could adversely affect the general economic interest.

Article 2 names some of the behaviors that constitute practices restricting competition.
Among practices restricting competition, Article 2(m) speaks of the illegal transfer of goods or supply of services at prices below their cost, for the purpose of displacing competition in the market or for causing harm to the image, patrimony, or value of the trademarks associated with the suppliers of those goods or services.

Article 2 of the Civil Code stipulates: “Laws shall not be binding until after their publication, and as of the stated day. If no day is stated, they shall be binding eight days following their official publication.”
This Law was published in the Official Gazette on September 20, 1999 (B.O. 20/09/99), with no specific date of entry into force; based on Article 2 of the Civil Code it entered into force eight days after its publication.
