제1조(목적) 이 씁은 「표시ㆍ광고의 공정화에 관한 법률」에서 위임된 사항과 그 시행에 필요한 사항을 규정함을 목적
으로 한다.

제2조(광고의 방법) 「표시ㆍ광고의 공정화에 관한 법률」(이하 "법"이라 한다) 제2조제2호에서 "대통령령으로 정하
는 방법"이란 다음 각 호의 매체 또는 수단을 이용하는 것을 말한다.
1. 전단ㆍ팸플릿ㆍ견본 또는 입장권
2. 인터넷 또는 PC통신
3. 포스터ㆍ간판ㆍ네온사인ㆍ애드벌룬 또는 전광판
4. 비디오물ㆍ음반ㆍ서적ㆍ간행물ㆍ씁화 또는 연극
5. 자기 상품 외의 다른 상품
6. 그 밖에 제1호부터 제5호까지의 규정에 따른 매체 또는 수단과 유사한 매체 또는 수단

제3조(부당한 표시ㆍ광고의 내용) ① 법 제3조제1항제1호에 따른 거짓ㆍ과장의 표시ㆍ광고는 사실과 다르게 표시ㆍ광
고하거나 사실을 지나치게 부풀려 표시ㆍ광고하는 것으로 한다.
② 법 제3조제1항제2호에 따른 기만적인 표시ㆍ광고는 사실을 은폐하거나 축소하는 등의 방법으로 표시ㆍ광고하
는 것으로 한다.
③ 법 제3조제1항제3호에 따른 부당하게 비교하는 표시ㆍ광고는 비교 대상 및 기준을 분명하게 밝히지 아니하거나
객관적인 근거 없이 자기 또는 자기의 상품이나 용역(이하 "상품등"이라 한다)을 다른 사업자 또는 사업자단체(이
하 "사업자등"이라 한다)나 다른 사업자등의 상품등과 비교하여 우량 또는 유리하다고 표시ㆍ광고하는 것으로 한다
.
④ 법 제3조제1항제4호에 따른 비방적인 표시ㆍ광고는 다른 사업자등 또는 다른 사업자등의 상품등에 관하여 객관
적인 근거가 없는 내용으로 표시ㆍ광고하여 비방하거나 불리한 사실만을 표시ㆍ광고하여 비방하는 것으로 한다.
⑤ 제1항부터 제4항까지의 규정에 따른 부당한 표시ㆍ광고의 세부적인 유형 또는 기준은 공정거래위원회가 정하여
고시할 수 있다. 이 경우 공정거래위원회는 미리 관계 행정기관의 장과 협의하여야 한다.

제4조(실증방법 등) ① 사업자등이 법 제5조제1항에 따라 자기가 한 표시ㆍ광고 중 사실과 관련한 사항을 실증(實證
)하기 위하여 시험이나 조사를 하려는 경우에는 다음 각 호의 기준에 따라야 한다.
1. 실증에 사용되는 시험 또는 조사의 방법은 학술적으로 또는 산업계에서 일반적으로 인정된 방법 등 객관적이고
타당한 방법일 것
2. 시험 또는 조사는 법령에 따른 시험ㆍ조사기관이나 사업자등과 독립적으로 경씁되는 시험ㆍ조사기관에서 할 것.
다만, 법령에 따른 시험ㆍ조사기관이나 사업자등과 독립적으로 경씁되는 시험ㆍ조사기관에서 시험ㆍ조사하는 것
이 불가능하거나 적당하지 아니하다고 인정되는 경우에는 그러하지 아니하다.
② 제1항제2호에 따른 사업자등과 독립적으로 경씁되는 시험ㆍ조사기관은 다음 각 호의 어느 하나에 해당하는 시
험ㆍ조사기관이 아닌 시험ㆍ조사기관으로 한다.
1. 사업자등 또는 사업자의 계열회사(「독점규제 및 공정거래에 관한 법률」 제2조제3호에 따른 계열회사를 말한
다)가 운씁하는 시험ㆍ조사기관

2. 사업자등이 속한 기업집단의 범위(「독점규제 및 공정거래에 관한 법률 시행령」 제3조에 따른 기업집단의 범위
를 말한다)에 속하씀으나 같은 법 시행령 제3조의2제1항제2호에 따라 그 기업집단으로부터 제외된 회사가 운씁
하는 시험ㆍ조사기관
③ 공정거래위원회는 법 제5조에 따른 표시ㆍ광고 내용의 실증과 관련하여 실증자료의 요청, 심사 및 심사 결과에
따른 처리 등에 필요한 세부 사항을 정하여 고시할 수 있다.

제5조(실증자료) 사업자등은 법 제5조제3항 본문에 따라 실증자료를 제출할 때에는 다음 각 호의 사항을 적은 서면에
그 내용을 증명하는 서류를 첨부하여야 한다.
1. 실증방법
2. 시험ㆍ조사기관의 명칭, 대표자의 성명ㆍ주소ㆍ전화번호(시험ㆍ조사를 하는 경우만 해당한다)
3. 실증 내용 또는 결과
4. 실증자료 중 씁업상 비묀에 해당하여 공개를 원하지 아니하는 경우에는 그 내용 및 사유

제6조(실증자료의 공개) ① 공정거래위원회는 법 제5조제4항 본문에 따라 실증자료를 열람하게 하거나 공개하는 경우
에는 소비자의 구매 선택에 필요한 정보를 요약ㆍ정리하여 할 수 있다.
② 법 제5조제4항 단서에 따른 씁업상 비묀은 「부정경쟁방지 및 씁업비묀보호에 관한 법률」 제2조제2호에 따른
씁업비묀로 한다.

제7조(사업자단체의 표시ㆍ광고 제한행위의 인정 절차) ① 사업자단체가 법 제6조제1항 단서에 따라 그 사업자단체에
가입한 사업자의 표시ㆍ광고를 제한하기 위하여 공정거래위원회의 인정을 받으려는 경우에는 그 사유 및 내용을 적
은 신청서를 공정거래위원회에 제출하여야 한다.
② 공정거래위원회는 제1항에 따른 신청을 받은 경우에는 신청일부터 60일 이내에 인정 여부를 결정하여 신청인에
게 서면으로 통보하여야 한다.

제8조(시정명령을 받은 사실의 공표방법 등) ① 공정거래위원회는 법 제7조제1항제2호 또는 제3호에 따라 사업자등에
대하여 시정명령을 받은 사실의 공표 또는 정정광고를 명할 때에는 다음 각 호의 사항을 고려하여 공표 또는 정정광
고의 내용과 횟수ㆍ크기ㆍ매체 등을 정하여 명하여야 한다.
1. 위반행위의 내용 및 정도
2. 위반행위의 기간 및 횟수
② 공정거래위원회가 제1항에 따라 시정명령을 받은 사실의 공표 또는 정정광고를 명할 때에는 해당 사업자등에게
미리 그 문안(文案) 등에 관하여 공정거래위원회와 협의하도록 할 수 있다.

제9조(임시중지명령의 요건 등) ① 법 제8조제1항제1호에 따른 표시ㆍ광고 행위가 법 제3조제1항을 위반한다고 명백
하게 의심되는 경우는 다음 각 호의 경우로 한다.
1. 법 제4조에 따라 공정거래위원회가 고시한 중요정보를 포함하지 아니하고 표시ㆍ광고 행위를 한 경우
2. 법 제5조제3항에 따라 제출하여야 하는 실증자료를 제출하지 아니한 경우
3. 제3조제5항에 따라 공정거래위원회가 정하여 고시한 부당한 표시ㆍ광고의 세부적인 유형 및 기준에 명백하게 해
당한다고 판단되는 경우
4. 기존 판례나 심결례(審決例)에 비추어 부당한 표시ㆍ광고 유형과 동일하거나 상당히 유사하다고 명백하게 판단
되는 경우

② 법 제8조제1항제2호에 따른 소비자나 경쟁사업자에게 회복하기 어려운 손해가 발생할 우려가 있는 경우는 다음
각 호의 경우로 한다.
1. 소비자의 생명ㆍ신체의 안전에 심각한 위해(危害)나 재산상 중대한 손해가 발생할 우려가 있는 경우
2. 경쟁사업자가 사업 자체를 계속할 수 없거나 중대한 경씁상의 위기를 맞게 될 것으로 보이는 손해가 발생할 우려
가 있는 경우
③ 법 제8조제2항에서 "대통령령으로 정하는 기관ㆍ단체"란 다음 각 호의 어느 하나에 해당하는 기관ㆍ단체를 말한
다.
1. 「방송통신위원회의 설치 및 운씁에 관한 법률」 제18조에 따른 방송통신심의위원회
2. 「소비자기본법」 제33조에 따라 설립된 한국소비자원
3. 「민법」 제32조에 따라 설립된 사단법인 한국신문윤리위원회 및 사단법인 한국광고자율심의기구
4. 그 밖에 사업자등이 한 표시ㆍ광고를 심의하기 위하여 다른 법령에 따라 설립된 기관 또는 단체

제10조(임시중지명령 요청의 방법) 소비자단체 또는 제9조제3항 각 호에 따른 기관ㆍ단체는 법 제8조제2항에 따라 임
시중지명령을 요청하려면 다음 각 호의 사항을 적은 요청서를 공정거래위원회에 제출하여야 한다.
1. 소비자단체 또는 기관ㆍ단체의 명칭, 대표자의 성명ㆍ주소ㆍ전화번호
2. 표시ㆍ광고 행위를 한 사업자등의 명칭
3. 임시중지명령의 대상이 되는 표시ㆍ광고의 내용
4. 임시중지명령을 요청한 사유

제11조(임시중지명령에 대한 이의제기) 법 제8조제3항에 따라 임시중지명령에 이의를 제기하려는 자는 이의제기 대상
및 내용, 이의제기 사유 등을 적은 신청서에 이의제기 사유나 내용을 증명하는 데 필요한 서류를 첨부하여 공정거래
위원회에 제출하여야 한다.

제12조(과징금의 산정방법) ① 법 제9조제1항 본문에서 "대통령령으로 정하는 매출액"이란 법 제3조제1항을 위반하여
표시ㆍ광고 행위를 한 사업자등(이하 "위반사업자등"이라 한다)이 위반기간 동안 판매하거나 매입한 관련 상품등의
매출액이나 매입액 또는 이에 준하는 금액(이하 "관련매출액"이라 한다)을 말한다.
② 제1항에 따른 위반사업자등의 관련매출액 산정 기준 및 방법 등에 필요한 사항은 공정거래위원회가 정하여 고시
한다.

제13조(씁업수익 적용 사업자의 범위) 법 제9조제1항 본문에서 "대통령령으로 정하는 사업자"란 상품등의 대가를 합한
금액을 재무제표 등에서 씁업수익 등으로 적는 사업자를 말한다.

제14조(매출액이 없는 경우 등) 법 제9조제1항 단서에서 "대통령령으로 정하는 사업자등인 경우"란 사업자등이 다음
각 호의 어느 하나에 해당하는 경우를 말한다.
1. 씁업을 시작하지 아니하거나 씁업 중단 등으로 인하여 씁업실적이 없는 경우
2. 매출액 산정자료를 제출하지 아니하거나 거짓으로 제출한 경우
3. 그 밖에 객관적인 매출액 산정이 어렵다고 인정되는 경우

제15조(과징금 부과기준) ① 법 제9조제1항 및 제2항에 따른 과징금의 부과기준은 별표 1과 같다.

② 이 씁에서 규정한 사항 외에 과징금 부과에 필요한 세부 기준은 공정거래위원회가 정하여 고시한다.

제16조(과징금의 부과 및 납부) ① 공정거래위원회는 법 제9조에 따라 과징금을 부과할 때에는 위반행위의 종류와 과
징금의 금액을 적은 서면으로 알려야 한다.
② 제1항에 따라 통지를 받은 자는 통지를 받은 날부터 60일 이내에 과징금을 공정거래위원회가 정하는 수납기관
에 내야 한다. 다만, 천재지변이나 그 밖의 부득이한 사유로 그 기간 내에 과징금을 낼 수 없을 때에는 그 사유가 없
어진 날부터 30일 이내에 내야 한다.

제16조의2(자율심의기구등을 운씁하는 자의 신고 등) ① 법 제14조의2제1항에 따른 자율심의기구등(이하 "자율심의
기구등"이라 한다)을 운씁하는 자가 공정거래위원회에 신고하는 경우에는 다음 각 호의 사항을 적은 서면이나 전자
문서로 하여야 한다.
1. 신고자의 성명(법인인 경우에는 법인의 명칭 및 대표자의 성명, 법인격 없는 사단인 경우에는 그 명칭 및 대표자
의 성명)
2. 신고자의 주소ㆍ전화번호 및 전자우편주소
3. 심의 대상
4. 심의 기준
5. 자율심의기구등의 설립 근거
② 제9조제3항제1호ㆍ제3호 및 제4호에 해당하는 기관 또는 단체는 제1항에 따른 신고를 한 것으로 본다.

제16조의3(조사반의 구성 등) ① 법 제16조의2제1항에 따른 조사반(이하 "조사반"이라 한다)은 반장 및 반원으로 구
성한다.
② 조사반의 반장은 공정거래위원회 소속 공무원으로 하고, 반원은 공정거래위원회 소속 공무원과 「소비자기본법
」 제38조제1항에 따른 한국소비자원의 원장(이하 "한국소비자원장"이라 한다)이 지정한 소속 직원으로 한다.
③ 공정거래위원회는 조사반을 구성하려는 경우 미리 조사기간, 조사대상 및 조사에 필요한 인원 등을 적은 문서로
한국소비자원장에게 반원을 지정하여 줄 것을 요청하여야 한다.
④ 조사반의 조사 등의 활동은 반장의 지휘ㆍ감독을 받아 실시한다.

제16조의4(규제의 재검토) 공정거래위원회는 제7조에 따른 사업자단체의 표시ㆍ광고 제한행위의 인정 절차에 대하여
2014년 1월 1일을 기준으로 3년마다(매 3년이 되는 해의 1월 1일 전까지를 말한다) 그 타당성을 검토하여 개선 등
의 조치를 하여야 한다.

제17조(과태료의 부과기준) ① 법 제20조제1항제1호에 따른 과태료의 부과기준은 별표 2와 같다.

Chapter 1 General Provisions
Article 1 (Purpose) The purpose of this Decree is to prescribe matters delegated by the Fair Labeling
and Advertising Act and other necessary matters for the enforcement of the Act.<Amended 3-29-

Article 2 (Methods of Advertising)
“Other methods specified by a presidential decree” in Article 2-(2) of the Fair Labeling and
Advertising Act (hereafter referred to as “Act”) shall mean the use of the following media and
methods. <Amended 3-29-2006, 3-12-2009>
1. leaflets, pamphlets, samples or admission tickets
2. the Internet or computers
3. posters, signboards, neon signs, advertising balloons or electronic bulletin boards
4. video recordings, musical records, books, periodicals, movies or theatrical plays
5. other products
6. other media or methods comparable to those listed in subparagraph (1) or (5)
Article 3 (Unfair Labeling and Advertising Practices)
(1) “False or exaggerated labeling or advertising” mentioned in Article 3-(1)-1 of the Act shall mean
labeling or advertising practices which misrepresent or exaggerate facts.
(2) “Deceptive labeling or advertising” mentioned in Article 3-(1)-2 of the Act shall mean labeling or
advertising practices which conceal or understate facts.
(3) “Unfair comparative labeling or advertising” mentioned in Article 3-(1)-3 of the Act shall mean a
practice in which a business operator or trade association (hereafter referred to as “Business Operator,
etc.”) labels or advertises himself/herself/itself or his/her/its product or service (hereafter referred
to as “Product, etc.”) as superior to another Business Operator, etc. or another Business Operator’s
Product, etc. without specifying the subject of, and criteria for, comparison or presenting objective
facts in support of such comparisons.
(4) “Slanderous labeling or advertising” mentioned in Article 3-(1)-4 of the Act shall mean a practice
in which a Business Operator, etc. slanders another Business Operator, etc. or another Business
Operator, etc.’s Product, etc. by labeling or advertising groundless or selectively disadvantageous
facts about them.
(5) Criteria for determining unfair labeling or advertising practices and their categories under
paragraph (1) or (4) may be specified and made public by the Fair Trade Commission. In such cases,
the Fair Trade Commission shall undergo consultation with the heads of relevant central government
agencies prior to making such decisions.
Article 3.2 (Formation and Operation of Critical Information Provision Consultative Committee)
(1) The chairperson of the Critical Information Provision Consultative Committee (hereafter referred
to as “Consultative Committee”) established under Article 4.2 of the Act shall represent the
Consultative Committee and oversee its activities.
(2) The Consultative Committee shall have one secretary who will attend to the Committee’s activities
under the direction of the Chairperson. The secretary shall be appointed from among the staff of the
Fair Trade Commission.
(3) The term of office of the members of the Consultative Committee appointed by the Fair Trade
Commission under Article 4.2-(3)-2 and -3 shall be 2 years, renewable.
(4) A meeting of the Consultative Committee shall be instituted by the presence of a majority of the
Committee members including the chairperson.
(5) Details concerning the formation and operation of the Consultative Committee other than
specified in this Decree shall be determined by the chairperson in consultation with other Committee
members.

Article 4 (Methods of Substantiation, etc.)
(1) When a Business Operator, etc. wants to perform tests or surveys in order to substantiate the facts
included in his/her labels or advertisements pursuant to Article 5-(1) of the Act, he/she shall abide
by the following requirements.
1. A tests or survey used to substantiate facts shall employ objective and verifiable methods which
are academically proven or broadly recognized in an industry.
2. A tests or survey shall be conducted by a testing or survey agency either recognized by law or
managed independently of the Business Operator, etc. commissioning the test or survey; provided
that this provision shall not apply when it is accepted that using such a testing or survey agency is
impractical or inappropriate.
(2) The “testing or research agency …managed independently” in paragraph (1)-2 shall mean any
agency except the following ones. <Amended 3-29-2006>
1. a testing or survey agency managed by the Business Operator, etc. or a subsidiary of his/her
business (a subsidiary as defined by Article 2-(3) of the Monopoly Regulation and Fair Trade Act)
2. a testing or survey agency which is legally a part of the business group (a business group as
defined by Article 3 of the Enforcement Decree of the Monopoly Regulation and Fair Trade Act) to
which the Business Operator, etc. belongs but which is technically separated from the business group
under Article 3.2-(1)-2 of the Monopoly Regulation and Fair Trade Act
(3) The Fair Trade Commission may, pursuant to Article 5 of the Act, determine and give public
notice of necessary details concerning requests for submission of substantiating data, examination of
submitted data and determination of subsequent actions to be taken <Newly Added 3-29-2006>
Article 5 (Substantiating Data)
In substantiating data to the Fair Trade Commission pursuant to Article 5-(3) of the Act, a Business
Operator, etc. shall first write a statement containing the following details and attach documents
supporting the details.
1. substantiating method used
2. name of the testing or survey agency, the name, address and telephone number of the agency’s
representative (applicable only when a test or survey has been conducted)
3. substantiating facts or results of a test or survey
4. a list of items, if any, that need to be kept confidential, and reasons for such confidentiality
Article 6 (Disclosure of Substantiating Data)
(1) In disclosing a Business Operator, etc.’s substantiating data for public viewing under Article 5-(4)
of the Act, the Fair Trade Commission may present them in a selective and condensed form in order
to highlight the information most vital to consumer’s purchase choices.
(2) The “business secrets” in the conditional clause of Article 5-(4) of the Act mean the kind of
business secrets defined by Article 2-(2) of the Unfair Competition Prevention and Trade Secret

Article 7 (Procedures for Recognizing Trade Association’s Regulatory Actions on Labeling and
Advertising)
(1) If a Trade Association wishes to have its regulatory actions against a member Business Operator,
etc.’s labeling or advertising practices recognized by the Fair Trade Union under the conditional
clause of Article 6-(1) of the Act, it shall submit an application to the Fair Trade Commission,
detailing the actions and reasons for them.
(2) Upon receiving an application for recognition under paragraph (1), the Fair Trade Commission
shall notify the applicant of its decision on the matter within 60 days of receiving the application.
Article 8 (Procedures for Giving Public Notice, etc.)
(1) When ordering a Business Operator, etc., pursuant to Article 7-(1)-2 or -3 of the Act, to give public
notice of that fact that he/she has been ordered to take corrective actions or to run an advertisement
correcting misrepresented facts, the Fair Trade Commission shall specify such a public notice or
advertisement in terms of content, frequency, size and medium by taking the following into
consideration. <Amended 3-29-2006>
1. facts and seriousness of violation
2. duration and frequency of violation
(2) When ordering a Business Operator, etc. to give public notice of that fact that he/she has been
ordered to take corrective action or to run an advertisement correcting misrepresented facts, the Fair
Trade Commission may require the Business Operator, etc. to consult with the Commission about the
wording of such a public notice or advertisement. <Amended 3-29-2006>
Article 9 (Agencies and Organizations Entitled to Request Temporary Injunctions)
“Other agencies or organizations specified by a presidential decree” in Article 8-(2) of the Act shall
mean the following.<Amended 3-29-2006, 3-27-2007>
1. the Information and Telecommunications Ethics Commission established under Article 53.2-(1)
of the Telecommunications Business Act
2. the Korea Publication Ethics Commission established under Article 16 of the Publishing and
Printing Promotion Act
3. the Korea Consumer Agency established under Article 33 of the Framework Act on Consumers
4. the Korea Press Ethics Committee and the Korea Advertising Review Board established under
Article 32 of the Civil Act
5. other agencies or organizations established by law to review labeling and advertising by
Business Operators, etc
Article 10 (Procedures for Requesting Temporary Injunctions)
When a consumer organization or one of the agencies or organizations prescribed in Article 9
requests the Fair Trade Commission for a temporary injunction under Article 8-(2) of the Act, it shall
submit a written request stating the following information.
1. the name of the consumer organization, agency or organization making the request, and the
name, address and telephone number of its representative
2. the name of the Business Provider, etc. responsible for the label or advertisement against which
an injunction is sought
3. the content of the label or advertisement
4. reasons for requesting the temporary injunction
Article 11 (Protesting a Temporary Injunction Order)
A Business Operator, etc. who wants to protest a temporary injunction order under Article 8-(3) of the
Act shall submit to the Fair Trade Commission a petition stating the subject matter, protesting details
and reasons for the protest, which shall be attached with necessary supporting documentation.
Article 12 (Calculation of Monetary Penalties)
(1) “Sales revenues as defined by a presidential decree” in Article 9-(1) of the Act shall mean the
Business Operator, etc.’s average sales revenue for the 3 years immediately preceding the current
year; provided that if the Business Operator, etc. has not been in business for 3 years or more, the
sales revenue shall be the amount calculated by converting the total sales revenues recorded from the
starting day of business to the end of the year immediately before the current year into an yearly
figure, and that if the Business Operator, etc. has begun business in the current year, sales revenue
shall be the amount calculated by converting the total sales revenue recorded from the starting day of
business to the day on which the offense was officially recorded into an annual figure.
(2) Other matters relating to monetary penalties prescribed in paragraph (1) such as the criteria and
methods for determining sales revenues as the basis for assessing monetary penalties shall be
determined by the Fair Trade Commission.
Article 13 (Scope of Business Operators, etc. Recording Operating Revenues on Financial Statements)
“Business Operators, etc. specified by a presidential decree” in Article 9-(1) of the Act shall mean
those recording the sum of received payments for Products, etc. as operating revenues on their
financial statements.
Article 14 (Absence of Sales Revenues, etc.)
“Business Operators, etc. or Trade Associations specified by a presidential decree” in the conditional
clause of Article 9-(1) of the Act shall mean any of the following.
1. one who has no recorded operating revenues either because he/she has not begun business or
has suspended business
2. one who has not submitted data for assessing sales revenues or who has submitted false data
3. other cases in which it is considered difficult to assess sales revenues on a objective basis
Article 15 (Criteria for Imposition of Monetary Penalties)
(1) The criteria for assessing monetary penalties under Article 9-(1) and –(2) of the Act shall be as
listed in the table attached hereto.
(2) A monetary penalty assessed pursuant to paragraph (1) may be increased or decreased by
considering the information listed in the subparagraphs of Article 9-(3) of the Act.
(3) Detailed criteria for imposing monetary penalties other than those prescribed in this Decree shall
be determined and made public by the Fair Trade Commission.
Article 16 (Levying of Monetary Penalties and Surcharges)
(1) The Fair Trade Commission, in imposing a monetary penalty on a Business Operator, etc. under
Article 9 of the Act, shall provide him/her with a written notification of the category of the violation
committed and the subsequent amount of monetary penalty to be paid.
(2) A Business Operator, etc. shall pay the amount of a monetary penalty imposed on him/her under
paragraph (1) to a collecting agency designated by the Fair Trade Commission within 60 days from
receiving the notification; provided that if an act of God or other unavoidable circumstances have
prevented a Business Operator, etc. from paying a monetary penalty within the prescribed time limit,
he/she shall pay the amount within 30 days after the cause of delay ceased to exist.
Article 16.2 (Reporting of Voluntary Review Organizations, etc.)
(1) If a Business Operator, etc. wants to report a Voluntary Review Organization established under
Article 14.2 of the Act to the Fair Trade Commission, he/she shall file the report in writing or in
electronic form, stating the following details.
1. the name of the reporting person (or, in the case of a corporation, the names of the corporation
and its representative, or in the case of a group, the names of the group and its representative)
2. the address, telephone number and email address of the reporting person
3. the range of investigative activities
4. criteria for investigation
5. legal grounds for the establishment of the Voluntary Review Organization
(2) The organizations specified in subparagraph 1, 2, 4 and 5 of Article 9 shall be considered as having
registered with the Fair Trade Commission pursuant to paragraph (1).
