The notification by Spain to the WTO under article 63.2 of TRIPS states:
'The Law is designed to establish a regulatory foundation to guarantee adequate competition in the market. This enactment embodies prevailing Community principles with regard to protection of competition.
The procedures established in Part III serve to determine when a practice or an agreement is anti-competitive. This is relevant for the purposes of 'Other Use Without Authorization of the Right Holder' set out in Article 31.k of the TRIPS Agreement.
The prohibited practices envisaged in Article 1 include those that could constitute contractual licence clauses. The Competition Protection Court may impose penalties (Article 9-13) on anyone engaging in unfair competition.'
