Details Details Year of Version 1881 Dates Entry into force: April 1, 1881 Adopted: February 3, 1881 Type of Text Main IP Laws Subject Matter Enforcement of IP and Related Laws Notes The notification by Spain to the WTO under article 63.2 of TRIPS states:
'Article 3 deals with questions relating to representation in court, which is relevant to Article 42 of the TRIPS Agreement.
Articles 313 and 314 regulate whether a particular legal proceeding will be in open court or in camera, which is relevant to Article 42 of the TRIPS Agreement.
Article 497.1 addresses the legal formulas for obtaining information on distribution channels in cases of infringement, which is relevant for the purposes of Article 47 of the TRIPS Agreement.
Article 903 ff. governs civil liability actions against judges and magistrates, which is relevant for the purposes of article 48 of the TRIPS Agreement.
Article 1428 sets forth the general procedure for initiating the process of adopting provisional measures. This procedure is applicable in the domain of unfair competition and is relevant to Article 50 of the TRIPS Agreement.'
