426. Verordnung des Bundesministers für Land- und Forstwirtschaft, mit der die Verordnung über die Erweiterung des sachlichen Anwendungsbereiches des Sortenschutzgesetzes geändert wird

Auf Grund des § 2 Abs. 2 des Sortenschutzgesetzes, BGBl. Nr. 108/1993, wird verordnet:

Die Verordnung des Bundesministers für Land- und Forstwirtschaft, BGBl. Nr. 455/1994, über die Erweiterung des sachlichen Anwendungsbereiches des Sortenschutzgesetzes wird wie folgt geändert:

l. Am Ende der Z 5 des § l ist an Stelle des Punktes ein Beistrich zu setzen und der Z 5 folgende Z 6 bis 25 anzufügen:

„6. Apfel (Malus Mill.),

7 Birne (Pyrus communis L.),

  1. Brombeere (Rubus L. subgenus Eubatus Sect. Moriferi & Ursini & hybrides),
  2. Erdbeere (Fragaria L.),
  3. Himbeere (Rubus idaeus L. & hybrides),
  4. Rote Johannisbeere [Ribes sylvestre (Lam.) Mert. & W D. J. Koch],
  5. Schwarze Johannisbeere (Ribes nigrum L.),
  6. Weiße Johannisbeere (Ribes niveum Lindl.),
  7. Marille, Aprikose (Prunus armeniaca L.),
  8. Mirabelle (Prunus insititia L.),
  9. Pfirsich, Nektarine [Prunus persica (L.) Batsch],
    17 Pflaume, Zwetschke (Prunus domestica L.),
  1. Quitte (Cydonia Mill.),
  2. Rose (Rosa L.),
  3. Sauerkirsche, Weichsel (Prunus cerasus L.),
  4. Stachelbeere (Ribes uva-crispa L.),
  5. Süßkirsche (Prunus avium L.),
  6. Triticale (X Triticosecale Wittm.),
  7. Waldrebe (Clematis L.),
  8. Zierquitte (Choenomeles Lindl.)."
  1. In §2 erhält der bisherige Text die Absatzbezeichnung „(1)".
  2. Dem § 2 Abs. l wird folgender Abs. 2 angefügt:

„(2) § l in der Fassung der Verordnung BGBl. Nr. 426/1995 tritt mit 1. Juli 1995 in Kraft."

application of the Species Protection Act

On the basis of § 2, paragraph 2 of the Species Protection Act, BGBl. No. 108/1993, it is ruled that:

The decree of the Federal Minister for Agriculture and Forestry, BGBl. No.455/1994 on the expansion of the scope of application of the Species Protection Act is amended as follows:

1. The full stop at the end of line 5 of § I shall be replaced by a comma and the following lines shall be added as lines 6 to 25:

“6. Apple (Malus Mill.), 7. Pear (Pyrus communis L.), 8. Blackberry (Rubus L., subgenus Eubatus Sect. Moriferi & Ursini & hybrides), 9. Strawberry (Fragaria L.), 10. Raspberry (Rubus idaeus L. & hybrides), 11. Red currant (Ribes sylvestre (Lam.) Mert. & W.D.J.Koch), 12. Black currant (Ribes nigrum L.), 13. White currant (Ribes niveum Lindi), 14. Apricot (Prunus armeniaca L.), 15. Syrian plum (Prunus insititia L.), 16. Peach, nectarine [Prunus persica (L.) Batsch], 17. Plum (Prunus domestica L.), 18. Quince (Cydonia Mill.), 19. Rose (Rosa L.), 20. Sour cherry (Prunus cerasus L.), 21. Gooseberry (Ribes uva-crispa L.) 22. Sweet cherry (Prunus avium L.), 23. Triticale (X Triticosecale Wittm.), 24. Clematis (Clematis L.) 25. Japanese quince (Choenomeles Lindl.)”

2. In § 2, the existing text shall be given the paragraph number “(1)”.

3. The following paragraph 2 shall be added to § 2, paragraph 1: “(2) § 1 as amended in the decree BGBl. No. 426/1995 shall enter into force on July 1, 1995.”
